Notice of Intention to Take a Cable Easement in Gross for Post Office Purposes in the City of Auckland

NOTICE is hereby given that it is proposed under the provisions of the Public Works Act 1928 to take an easement in gross over the land described in the Schedule hereto for post office purposes, vesting in Her Majesty the Queen, her agents, and workmen, the right from time to time to lay a cable or cables under the said land, together with the right from time to time to enter upon the said land with all requisite machinery or conveyances for the purposes of laying, repairing, or renewing the said cable or cables and for erecting and maintaining such fixtures as may be necessary to indicate the location of the said cable or cables; and notice is further given that a copy of the plan of the land over which the easement is required is deposited in the post office at Mission Bay and is there open for inspection; that all persons directly affected by the taking of the said easement should, if they have any objection to the taking of the said easement, not being an objection to the amount or payment of compensation, make a written objection and send it within 40 days after the first publication of this notice, to the Town and Country Planning Appeal Board at Wellington; and that, if any objection is made in accordance with this notice, a public hearing of the objection will be held, unless the objector otherwise requires, and each objector will be advised of the time and place of the hearing.

ALL that piece of land containing 48 square metres in the City of Auckland and being Allotment 283, District of Tamaki; as shown edged red on plan 1/732/1/3104/1 deposited in the office of Minister of Works and Development at Wellington and thereon marked “A”. Part certificate of title, No. 5C/486, North Auckland Land Registry. The said land is situated at 77 Patteson Avenue, Mission Bay.

PURSUANT to section 32 of the Public Works Act 1928, the Minister of Works and Development hereby declares that, a sufficient agreement to that effect having been entered into, the land described in the Schedule hereto is hereby taken for a recreation ground and shall vest in the Mayor, Councillors, and Citizens of the City of Lower Hutt from and after the 17th day of February 1977.
