ORDER IN COUNCIL
At the Government House at Wellington this 28th day of November 1977
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
PURSUANT to the Local Government Act 1974, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order:
ORDER
COMMENCEMENT
- This order shall come into force on the 1st day of April 1978.
CONSTITUTION
- The districts of the Borough of Waipawa and the County of Waipawa shall be united under the name of the “Waipawa District” (referred to in this order as “the district”).
- The council of the district shall be known as the “Waipawa District Council” (referred to in this order as “the district council”).
- The Waipawa Borough Council and the Waipawa County Council (referred to in this order as “the uniting authorities”) shall be dissolved.
COMMUNITIES
- The area of the former Borough of Waipawa shall be a community administered by a district community council, having the name of the “Waipawa District Community Council” and the Waipawa District Community Council shall comprise seven members.
- The district council may appoint a councillor or councillors to officiate at functions within the Waipawa community which were formerly attended by the Mayor of Waipawa.
- The community and community council of Takapau shall enure as if constituted by the district council.
REPRESENTATION
-
For a period of not less than five years the district council shall comprise nine councillors and the district shall be divided into five ridings having representation on the district council as follows:
Argyll Riding—comprising the area of the Waipawa Riding of the former County of Waipawa (2 councillors);
Takapau Riding—comprising the area of the Takapau Riding of the former County of Waipawa (1 councillor);
Onga Onga Riding—comprising the area of the Onga Onga Riding of the former County of Waipawa (2 councillors);
Clinton Riding—comprising the area of the Clinton Riding of the former County of Waipawa (1 councillor);
Waipawa Riding—comprising the area of the former Borough of Waipawa (3 councillors). -
The first meeting of the district council shall be convened by the person holding the office of County Clerk of Waipawa immediately prior to union, and at that meeting there shall be elected one member of the district council to be chairman.
FUNCTIONS AND POWERS
- Except as otherwise provided in this order the Counties Act 1956 shall apply to the district as if it were a county and to the district council as if it were a county council.
- For the purposes of any other enactment the district shall be a county and the district council shall be a county council.
RECORDS
- All the valuation rolls, electors’ lists, electors’ rolls, and rate records in force in the districts of the uniting authorities immediately prior to the date of union shall be deemed to be the valuation rolls, electors’ lists, electors’ rolls, and rate records of the district until new valuation rolls, electors’ lists, electors’ rolls, and rate records are completed for the district.
RATING
- The system of rating within the district shall be the land value system.
FINANCE GENERALLY
- Except as otherwise provided herein, the accounts of the district council shall be kept in accordance with the provisions of the Local Government Accounting Regulations 1974.
- The opening balance of the Waipawa Community Account shall be the closing balances of the General and Separate Rates and General Appropriation Accounts of the
