Consenting to Raising of Loans by Certain Local Authorities

PURSUANT to the Local Authorities Loans Act 1956, the
undersigned Assistant Secretary to the Treasury, acting under
powers delegated to the Secretary to the Treasury by the
Minister of Finance, hereby consents to the borrowing by

Decision of the Indecent Publications Tribunal

DECISION

This group of documents come before us on reference
from the Magistrate’s Court in proceedings for condemnation,
under the Customs Act 1966, following disputed forfeiture
by the Customs Department. We were told that the
material was imported by a private importer in September
1974 for his own use and not for sale, he having purchased
them from a book shop or book shops in Sydney. We were
not given any explanation for the apparent delay since seizure
in September 1974.

The documents are not all of the same kind and rather
different considerations apply to some of them.

The magazines New Apollo, Mankind, Body, Male International
Nudes and Australian Golden Boys consist entirely,
or almost entirely, of photographs of young men naked and
photographed so as to emphasise the penis.

Era consists almost entirely of naked and partly clothed
young men. There is not the same emphasis on the penis
in this book and it is said in the text that it is intended
as a retrospective work republishing photographs of “famous
models” whose photographs had appeared in other magazines
from the days before “the frontal nude type of physique
pictorial”. All these magazines are clearly published to appeal
to homosexuals.

Stallion and CIAO are both magazines which have a considerable
amount of text but with some photographs, especially
in the case of CIAO, similar to the first group mentioned
above. Both magazines are frankly homosexual and applaud
and appear to be intended to encourage homosexual associations.

Gay and Ribald look like newspapers published in Australia
by the same company. Neither are dated and we conclude
from internal evidence that they are occasional publications
which come within the definition of magazines. The first
of these is homosexual, the latter is heterosexual. Both contain
photographs, cartoons, and advertisements which are
clearly indecent in themselves.

In submissions to us Mr Neville urged us to take into
consideration (inter alia) a number of publications and extracts
from publications which, it was alleged, were available for
purchase in New Zealand in September 1974 or later. One
of these, Australian Golden Boys Vol. 1, No. 1, was classified
indecent in Decision 722 (New Zealand Gazette No. 80, 23
August, p. 1618). None of the others had come before us
previously at least in the form presented to us at this hearing.

In all the circumstances, we believe that such material
is not relevant to our consideration of the documents now
before us.

We have given careful consideration to the submissions
made to us and to the matters referred to in section 11
of the Act. The photographic material, the text, advertisements,
and cartoons in each of the documents lead us to
conclude that the dominant effect of each is objectionable
and injurious to the public good. Although this is not a
case of intended distribution for gain, the documents readily
lend themselves to improper and harmful use.

In conclusion, we should record some sympathy for the
importer who after 18 months finds himself a private importer
of indecent documents, but this is not a matter which
can affect our decision.

The Tribunal classifies each document as indecent.
