Provided further that before or upon the above financial divisions ceasing to exist and upon application to the Local Government Commission by the Waitomo District Council, the period during which the land value system and the capital value system shall apply to the areas of the former Te Kuiti Borough and the former Waitomo County respectively may be extended as the Commission determines.

For the purposes of section 5 of the Rating Act 1967 (relating to land not rateable), the Urban Financial Division shall be deemed to be a borough.

The provisions of Part IX of the Rating Act 1967 (relating to valuation equalisation) and of section 107 and 111A to 1110 of the Counties Act 1956 (relating to the levying of general rates) shall apply to the Waitomo District as if each financial division provided for in this order were a riding of a county.

All the valuation rolls, electors' lists, electors' rolls, and rate records in force within the districts to be united immediately preceding the date of union shall continue in force in the Waitomo District until new valuation rolls, electors' lists, electors' rolls, and rate records are made for the Waitomo District.
FINANCE GENERALLY

Except as hereinafter provided, the accounts for each financial division shall be kept in the manner provided for in Form 7 of the Local Government Accounting Regulations 1974, and the opening balances of each such account shall be the closing balances of the General and Separate Rates and General Appropriation Accounts of the Te Kuiti Borough and the Waitomo County Councils at the date of their dissolution.

All other administrative accounts, works and services accounts and special funds of the Te Kuiti Borough and the Waitomo County as at the date of their union shall be merged to operate as accounts of the district council:
Provided that all special funds shall be expended only for the purposes for which they were set aside and for the benefit only of the financial division from which they originated.
- For the purposes of the Local Authorities (Petroleum Tax) Act 1970 the District Council shall be the successor of the Waitomo County Council and the Te Kuiti Borough Council.
TRANSITIONAL PROVISIONS

Except as otherwise provided in this order the provisions of section 10 of the Counties Act 1956 (which relates to the succession to assets, liabilities, engagements and bylaws of united districts) shall apply to the union of districts as if the Te Kuiti Borough were a county.

The communities and community councils of the Waitomo County shall enure as if they had been constituted and appointed by the district council.

The district council shall not be required forthwith, as provided by section 28B of the Town Country Planning Act 1953, to prepare a new district scheme for the whole of its district.

Pursuant to section 8 (1) of the Auckland Metropolitan Drainage Act 1960, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, and on the petition of the Auckland Regional Authority, hereby makes the following order.
ORDER

This order shall come into force on 1 April 1976.

The boundaries of the Inner Area of the Auckland Metropolitan Drainage District are hereby altered so as to include in the Inner Area the areas described in the Schedule hereto.
SCHEDULE
All that area in the North Auckland Land District, Waitemata City, bounded by a line commencing at the southernmost corner of Lot 5, D.P. 19869 in Block XIV, Waitemata Survey District and proceeding north-westerly along the south-western boundary of that Lot 5 and northerly generally along the generally western boundaries of Lots 4 and 1, D.P. 19869, Lot 1, D.P. 63693, Lots 2 and 3, D.P. 18695 to a point in line with the north-easternmost boundary of Lot 2, D.P. 41889; thence north-westerly generally along a right line across Birdwood Road to the easternmost corner of that Lot 2 and along another right line recrossing Birdwood Road to the southernmost corner of Lot 1, D.P. 50606, and along the south-western boundary of that Lot 1 to the eastern boundary of an area of 3 acres and 26 perches (1.2798 hectares) shown on S.P. Plan 46206; thence northerly generally along that eastern boundary to and easterly generally, south-easterly and south-westerly along the generally northern, north-eastern, and south-eastern boundaries of Lot 1, D.P. 50606, to the northern side of a public road; thence easterly generally along that northern roadside to the middle of Swanson Stream; thence south-westerly along the boundary of the Inner Area of the Auckland Metropolitan Drainage District as described in New Zealand Gazette 1970, page 98 to the point of commencement.
Also all that area in the North Auckland Land District, Waitemata City, bounded by a line commencing at the easternmost corner of Lot 10, D.P. 65390, on the western side of Don Buck Road in Block X, Waitemata Survey District, and proceeding westerly along the northern boundary of that Lot 10 to and northerly generally along the western boundaries of Lots 25, 24, 23, 22, 21, 20, 19, 18, 17, 16, 15, 14, 13, 12, and 11, D.P. 44480 and along a right line to and along the generally western boundaries of Lots 10, 9, 8, 7, 6, 5, 4, 3, 2, and 1, D.P. 44480 to the northernmost corner of that Lot 1; thence easterly along the northern boundary of that Lot 1 to and northerly along a series of right lines 250 links (50.29 metres) distant from and parallel to the western side of Don Buck Road to the intersection with the north-western boundary of Lot 45, D.P. 2088, produced south-westerly; thence north-easterly along that production, the north-western boundaries of that Lot 45, D.P. 2088, Lot 1, D.P. 69411, along a right line to and along the north-western boundary of Lot 1, D.P. 69410, to its northernmost corner and along a right line to the westernmost corner of Lot 2, D.P. 69410; thence south-easterly generally along the boundary of the Inner Area of the Auckland Metropolitan Drainage District as described in New Zealand Gazette 1972, page 486, to and southerly and westerly generally along the boundary of the Inner Area of the Auckland Metropolitan Drainage District as described in the Third Schedule to the Auckland Metropolitan Drainage Act 1960 to the point of commencement.
Also all that area in the North Auckland Land District, Waitemata City, bounded by a line commencing at the southernmost corner of Lot 9, D.P. 7398, on the eastern side of Simpsons Road in Block XIV, Waitemata Survey District, and proceeding northerly along the eastern side of Simpsons Road to and northeasterly generally along the boundary of the Inner Area of the Auckland Metropolitan Drainage District as described in New Zealand Gazettes 1974, page 505, 1969, page 1714, and again 1974, page 505, to the southern side of the North Auckland Railway; thence easterly and southerly generally along the boundary of the Inner Area of the Auckland Metropolitan Drainage District, as described in the Third Schedule to the Auckland Metropolitan Drainage Act 1960, and southerly generally along the boundary of the Inner Area of the Auckland Metropolitan Drainage District, as described in New Zealand Gazette 1968, page 124, to the northern side of Henderson Valley Road in Block II, Titirangi Survey District; thence westerly generally along the northern side of Henderson Valley Road to and northerly generally along the eastern side of Candia Road and Simpsons Road to the point of commencement.
Also all that area in the North Auckland Land District, Waitemata City, bounded by a line commencing at a junction of the northern side of Swanson Road with the middle of Swanson Stream, in Block XIII, Waitemata Survey District, and proceeding westerly generally along the northern side of Swanson Road to and along the south-western boundaries of Lot 9, D.P. 40861 to its westernmost corner; thence northerly generally along the eastern side of McEntee Road to the northern boundary of Lot 1, D.P. 45101; thence easterly along the northern boundaries of Lots 1, 4 and 5, D.P. 45101, and the last boundary produced across Allotment 167, Waipareira Parish, and a public road to the middle of Swanson Stream; thence south-westerly along the boundary of the Inner Area of the Auckland Metropolitan Drainage District, as described in the Third Schedule to the Auckland Metropolitan Drainage Act 1960, to the point of commencement.
