of Trade and Industry relating to the price of cement manufactured and sold by the appellant.
After very careful review of all the submissions and evidence, and after having regard to the relevant subsections of section 98 of the Act, the Commission considered that the appellant failed to establish its case for an increase in return on adjusted shareholders' funds beyond the present authorised rate for this company of 21.5 percent.
However, up-dated financial information requested by the Commission and tabled during proceedings demonstrated that on the basis of 21.5 percent return on adjusted funds, the appellant was entitled to recover an immediate increase of $1.63 per tonne. This increase was supported by the Department of Trade and Industry.
In addition, and despite the fact that upon the evidence the Commission held that it could not grant the appeal, it considered that in terms of the Commission's wide powers under section 101 (3) of the Act the appellant should receive some relief on other grounds.
The Commission accordingly resolved: (a) to approve a price increase of $1.63 per tonne on the appellant's present authorised maximum selling prices; (b) to further approve an additional price increase of $0.57 per tonne (both the above increases to be effective from 12 March 1976); (c) to dismiss the appeal in all other respects.

Industrial Relations Act 1973—Proposed Cancellation of Registration of Industrial Union
PURSUANT to section 195 of the Industrial Relations Act 1973, it is hereby notified that unless cause to the contrary is shown, I intend to cancel the registration of the New Zealand Urban Fire Authorities' Industrial Union of Employers, Registered No. 1867, situated at Royal Exchange House, 111–115 Customhouse Quay, Wellington, on the expiration of 6 weeks from the date of the publication of this notice in the Gazette.

Licensing McCallum Bros. Ltd. to Occupy a Site for Shingle Washing and Recovery Operations on Karamuramu Island
PURSUANT to sections 162 and 265A of the Harbours Act 1950, I, Owen John Conway, of the Ministry of Transport, in exercise of powers delegated by the Minister of Transport, hereby license and permit McCallum Bros. Ltd. (hereinafter called the licensee, which term shall include its successors or assigns unless the context requires a different construction) to use and occupy a part of the foreshore of Karamuramu Island in the Hauraki Gulf shown as areas marked A and B on plan marked M.D. (N) 184 and deposited in the office of the Ministry of Transport, at Auckland, for the purpose of shingle washing and recovery operations as shown on the said plan, such licence to be held and enjoyed by the licensee upon and subject to the terms and conditions set forth in the Schedule hereto.
SCHEDULE
CONDITIONS
(1) This licence is subject to the Foreshore Licence Regulations 1960, and the provisions of those regulations shall, so far as applicable, apply hereto.
(2) The term of the licence shall be 14 years from the 1st day of March 1976.
(3) The premium payable by the licensee shall be twenty dollars ($20) and the annual sum so payable by the licensee shall be twenty dollars ($20); provided always that the Minister may review the annual sum payable at the end of the first year or any subsequent year of the said term.

PURSUANT to clause (1) of regulation 49 of the Traffic Regulations 1956*, the Deputy Secretary for Transport hereby approves for the purpose of subclauses (3), (4), and (4A) of regulation 43 of the said regulations, sirens of the make and type described in the Schedule hereto.

The Road Classification National Roads Board Notice No. 3, 1976
PURSUANT to regulation 3 of the Heavy Motor Vehicle Regulations 1974, the Deputy Secretary for Transport hereby gives the following notice.
NOTICE

This notice may be cited as the Road Classification (National Roads Board) Notice No. 3, 1976.

It is hereby declared, as required by the National Roads Board, that the State highway as set out in the Schedule hereto shall belong to the class set out in the said Schedule.

The notice dated the 5th day of February 1976*, which relates to the classification of the road described in the Schedule hereto is hereby revoked.
