Declaring Land Taken for Road and a Batter Easement in Gross Over Land Taken for the Use, Convenience, or Enjoyment of a Road, in the City of Timaru

Pursuant to section 32 of the Public Works Act 1928, the Minister of Works and Development hereby declares that, a sufficient agreement to that effect having been entered into, the land described in the First Schedule hereto is hereby taken for road, and the batter easement in gross described in the Second Schedule hereto is hereby taken for the use, convenience, or enjoyment of a road over the land described in the Third Schedule hereto from and after the 15th day of January 1976.

FIRST SCHEDULE

Canterbury Land District

All that piece of land containing 241 square metres, situated in the City of Timaru, being part Lots 238 and 240, D.P. 1; as shown on plan S.O. 13574 lodged in the office of the Chief Surveyor at Christchurch, and thereon marked "B".

SECOND SCHEDULE

Canterbury Land District

A batter easement in gross vesting full and free right, liberty, and license at all times for Her Majesty the Queen to enter upon and deposit spoil and create and maintain a batter for Theodosia Street on the parcel of land described in the Third Schedule hereto, together with full and free right, liberty, and license to Her Majesty's servants, agents, and workmen at all times to enter upon and occupy the said parcel of land for the purpose of carrying out any works, repairs, replacements, or excavations, or constructions where the same or any of them may, in the opinion of Her Majesty the Queen, be necessary to ensure the safety or full use and enjoyment of the said Theodosia Street.

THIRD SCHEDULE

Canterbury Land District

All that piece of land containing 406 square metres, situated in the City of Timaru, being part Lots 238 and 240, D.P. 1; as shown on plan S.O. 13574 lodged in the office of the Chief Surveyor at Christchurch and thereon marked "D".
