A PROCLAMATION
PURSUANT to the Public Works Act 1928, I, Sir Edward Denis Blundell, the Governor-General of New Zealand, hereby proclaim and declare that the land described in the Schedule hereto is hereby taken for public buildings of the General Government; and I also declare that this Proclamation shall take effect on and after the 22nd day of August 1974.

Commission of Inquiry into Distribution of Motor Spirits and Ancillary Products

ORDER IN COUNCIL
To all unto whom these presents shall come, and to:
RUSSELL TALBOT FEIST, Esquire, of Wellington, Barrister and Solicitor;
GORDON HAROLD ANDERSEN, Esquire, of Auckland, Trade Union Secretary; and
JOHN JOSEPH O'DEA, Esquire, of Dunedin, Company Director:
GREETING:
WHEREAS it is expedient that inquiry should be made into the storage and distribution of motor spirits and ancillary products within New Zealand for the general purposes of recommending what changes are necessary and what things should be done for promoting the economic development of the distribution industry and the service to and protection of the consumer, and matters incidental thereto:
And whereas you the said Russell Talbot Feist, Gordon Harold Andersen, and John Joseph O'Dea were, pursuant to section 13 of the Trade and Industry Act 1956, appointed on the 10th day of May 1974 by the Minister of Trade and Industry to be a Committee of Inquiry into the Distribution of Motor Spirits and Ancillary Products:
And whereas it is now expedient that the said Committee of Inquiry should be reconstituted a Commission of Inquiry pursuant to the Commissions of Inquiry Act 1908:
Now therefore, pursuant to the Commissions of Inquiry Act 1908, I, Sir Edward Denis Blundell, the Governor-General of New Zealand, acting by and with the advice and consent
of the Executive Council, hereby appoint you the said Russell Talbot Feist, Gordon Harold Andersen, and John Joseph O'Dea to be a Commission to inquire into, report upon, and make recommendations upon the storage and distribution of motor spirits and ancillary products within New Zealand, with particular regard to the following matters:
(a) The extent of competition in the wholesaling and retailing of motor spirits and ancillary products, and whether in the public interest steps should be taken to modify the present practices in the industry, and any legislation relating thereto:
(b) The efficiency of the present distribution of motor spirits and ancillary products, and any specific changes that you consider necessary to improve the efficiency of the industry:
(c) The changes in patterns and terms of trade which have taken place in the wholesaling and retailing of motor spirits and ancillary products, with particular reference to consumer demand, density of retail outlets, hours of trading, credit facilities, and development of highway service stations:
(d) Any changes which have taken place in the service rendered to the consumer, and whether any further specific changes are now seen to be desirable:
(e) The reasonableness or otherwise of the costs, gross profits, and net profits achieved or incurred by wholesalers and retailers of motor spirits and ancillary products:
(f) The extent and manner in which overseas interests influence the supply, storage, and distribution of motor spirits and ancillary products within New Zealand:
(g) The motor spirits price-fixing structures and procedures at wholesale and retail level:
(h) The steps, if any, which in the light of the findings on the preceding terms of reference should be taken in the public interest to achieve the most economic, socially desirable, and equitable means of distribution of motor spirits and ancillary products—
and generally to inquire into and report upon such other matters arising thereout as may come to your notice in the course of your inquiries and which you consider should be investigated in connection therewith, and to report upon any matters affecting the premises which you consider should be brought to the attention of the Government, and in particular, to report your opinion whether any additional legislation is necessary and the scope of the same:
And with the like advice and consent I do further appoint you the said RUSSELL TALBOT FEIST to be the Chairman of the said Commission:
And you are hereby authorised and empowered to take into account in your inquiries any information obtained by or supplied to the said Committee of Inquiry into the Distribution of Motor Spirits and Ancillary Products appointed on the 10th day of May 1974 by the Minister of Trade and Industry pursuant to section 13 of the Trade and Industry Act 1956:
And for the better enabling you to carry these presents into effect you are hereby authorised and empowered to make and conduct any inquiry under these presents, in accordance with the Commissions of Inquiry Act 1908, at such times and places as you consider expedient, with power to adjourn from time to time and place to place as you think fit, and so that these presents shall continue in force and the inquiry may at any time and place be resumed although not regularly adjourned from time to time or place to place:
And you are hereby strictly charged and directed that you shall not at any time publish or otherwise disclose, save to me in pursuance of these presents or by my direction, the contents or purport of any report so made or to be made by you or any evidence or information obtained by you in exercise of the powers hereby conferred upon you except such evidence or information as is received in the course of a sitting open to the public:
And it is hereby declared that the powers hereby conferred shall be exercisable notwithstanding the absence at any time of any one of the members hereby appointed so long as the Chairman or a member deputed by the Minister of Trade and Industry to act in his stead and one other member are present and concur in the exercise of the powers:
And using all due diligence, you are required to report to me in writing under your hands not later than the 31st day of May 1975 your findings and opinions on the matters aforesaid, together with such recommendations as you think fit to make in respect thereof.
