(b) The rate revenue of the said borough for the previous financial year shall be that part of the rate revenue of Waitemata County District existing prior to the constitution of the said borough which was derived from the area described in the First Schedule hereto, and the rate revenue of the balance of that county shall be reduced accordingly.
- (i) Notwithstanding anything to the contrary contained in this order the constitution of the said borough shall be deemed to have come into effect for all accounting, rating and other financial purposes including the apportionment of assets and liabilities as from and including the 1st day of April 1974.
(ii) Notwithstanding the provisions of subclause (i) of this clause for the period commencing the first day of April 1974 and ending on the date of the coming into office of the interim council referred to in clause 10, the Waitemata County Council shall be and is hereby authorised to do all things necessary relating to accounting, rating and other financing in regard to the area of the Waitemata County included within the said borough as if the said inclusion had not taken place, and all monies due to and payable by the said council during the said period shall be due to and payable by the Waitemata County Council as agent for and on behalf of the said council.
(iii) The provisions of this clause shall in like manner apply to the Auckland City Council in respect of that portion of the City of Auckland to be included in the said borough.
(iv) All transactions carried out in terms of subclauses (ii) and (iii) of this clause shall be accountable to the interim council after the said interim council takes office.
FIRST SCHEDULE
AREA TO BE EXCLUDED FROM WAITEMATA COUNTY
All that area in the North Auckland Land District bounded by a line commencing in Block I, Waitakere Survey District, at the intersection of the sea coast of the Tasman Sea and the middle of the Waitakere River and proceeding north-easterly generally up the middle of the Waitakere River to its junction with the production northerly of the eastern boundary of Lot 1, D.P. 57923 in Block XI, Kumeu Survey District; thence southerly along that production to a point in line with the eastern boundary of Lot 1, D.P. 57924 in Block XII, Kumeu Survey District; thence northerly along a right line to end along that eastern boundary and that boundary produced to the middle of the Waitakere River; thence easterly up the middle of the Waitakere River to its intersection with the middle of Bethells Road; thence north-easterly along the middle of Bethells Road to a point in line with the south-western boundary of that part of Allotment 5, Waitakere Parish as shown on D.P. 3912; thence north-westerly to and along that south-western boundary and north-easterly along the north-western boundary of the said part Allotment 5 and that boundary produced to the middle of a public road forming the north-eastern boundary of Lot 1, D.P. 41021; thence north-westerly along the middle of that road, to and easterly along the middle of a public road forming the southern boundaries of the land shown on D.P. 31015, to and north-easterly along the middle of Bethells Road, to a point in line with the north-eastern boundary of that part Allotment 27, Waipareira Parish, taken for recreation ground (Gazette, 1952, p. 1177); thence north-westerly along a right line to and along the north-eastern boundary of the said part Allotment 27 to its northernmost corner; thence north-easterly along a right line to the southernmost corner of Lot 8, D.P. 41523, and along the generally south-eastern boundaries of that Lot 8 and the southern boundary of Lot 7, D.P. 41523 and that boundary produced to the middle of Waitakere Road; thence northerly generally along the middle of Waitakere Road, to and northerly along the middle of Taupaki Road, to and easterly along the middle of State Highway No. 16, to a point in line with the north-western boundary of Lot 5, D.P. 53169 in Block IX, Waitemata Survey District; thence north-easterly along a right line to and along that north-western boundary and easterly along the northern boundaries of that Lot 5 and Lot 6, D.P. 53169 to the left bank of Brighams Creek; thence southerly along the left bank, to and northerly generally along the right bank of Brighams Creek, to and easterly and southerly generally along the line of mean high water of the Waitemata Harbour and its creeks and
continuing along the left bank of the Henderson Creek to its junction with the southern boundary of Lot 6, D.P. 1263, in Block XIV, Waitemata Survey District; thence westerly, southerly, easterly, and northerly generally along the northern, western, southern, and eastern boundaries of the Borough of Henderson as described in New Zealand Gazette, 1957, p. 1294, to and northerly generally along the line of mean high water of the right bank of the Henderson Creek to and southerly generally along the line of mean high water of the Waitemata Harbour to and along the line of mean high water of the left bank of the Whau River and its tributaries to and southerly generally along the western boundary of the Borough of New Lynn as described in New Zealand Gazette, 1939, p. 1728, to and westerly, southerly, and easterly generally along the generally northern, western, and southern boundaries of the Borough of Glen Eden as described in New Zealand Gazette, 1953, p. 498, to and easterly generally along the generally southern boundary of the aforesaid Borough of New Lynn to and southerly along the generally western boundary of the City of Auckland as described in New Zealand Gazette, 1956, p. 1084, to and south-westerly generally along the line of mean high water spring tide of the Manukau Harbour to and northerly along the sea coast of the Tasman Sea to the point of commencement.
SECOND SCHEDULE
AUCKLAND CITY AREAS TO BE INCLUDED IN WAITEMATA BOROUGH
All that area in the North Auckland Land District bounded by a line commencing in Block VII, Titirangi Survey District, at the intersection of the left bank of the Avondale Stream with the western side of Portage Road and proceeding north-easterly generally along the said left bank to its intersection in Block III, Titirangi Survey District, with the northern boundary of part Allotment 363, Waikomiti Parish, taken for New Lynn Domain by New Zealand Gazette, 1938, p. 1552; thence easterly and southerly along the northern and eastern boundaries of the said part Allotment 363 to and westerly along the northern side of Heaphy Street to a point in line with the western boundary of Lot 1, D.P. 52190; thence southerly along a right line across Heaphy Street to and along the western boundary of Lot 1, D.P. 52190, and continuing along the generally eastern boundary and south-westerly along the south-eastern boundary of the said part Allotment 363 to its southernmost corner; thence southerly along the eastern side of Portage Road to its junction with the southern side of Connaught Street; thence easterly along that southern side to the eastern boundary of Allotment 381, Waikomiti Parish; thence southerly and westerly along the eastern and southern boundaries of Allotment 381 aforesaid and southerly along the eastern boundary of Allotment 384, Waikomiti Parish, and that boundary produced across Taunton Terrace to the line of mean high water of the Manukau Harbour; thence westerly generally along the said line of mean high water, to its junction with the western side of Portage Road; thence northerly along that western side to the point of commencement.
THIRD SCHEDULE
TITIRANGI URBAN WARD
All that area in the North Auckland Land District, bounded by a line commencing in Block VII, Waitakere Survey District, at the intersection of the line of mean high water of the Tasman Sea and the middle of the Pararaha Stream and proceeding easterly generally up the middle of that Stream to a point in Block V, Waitakere Survey District in line with the north-western boundary of Allotment 57, Karangahape Parish as shown on D.P. 3258; thence north-easterly along a right line to the westernmost corner of Allotment 57 aforesaid and south-easterly along the south-western boundary of the said Allotment 57, to and north-easterly along the north-western boundaries of Allotments 103, 108, 104, and 105, and the south-eastern boundary of Allotment E64; thence north-westerly along the north-eastern boundary of Allotment E64 and that boundary produced to and north-easterly generally along the middle of the public road forming the south-eastern boundaries of Allotments 62 and 63, to and south-easterly generally along the middle of the public road forming the south-western boundaries of Lot 1, D.P. 3192, to its junction with the north-western boundary of Allotment 18 in Block IX, Titirangi Survey District; thence south-westerly along that north-western boundary and continuing along the south-eastern boundary of Allotment NE66 to and south-easterly along the middle of the public road forming the south-western boundaries of Allotments 18 and 19, to a point in line with the south-eastern boundary of the said Allotment 19;
