The Control of Prices (Positive List) Notice 1974
WHEREAS by subsection (1), section 18, of the Control of
Prices Act 1947 (as substituted by section 3 of the Control
of Prices Amendment Act 1953 and amended by section 2
of the Control of Prices Amendment Act 1956), it is provided
that the Minister of Trade and Industry may from time
to time publish in the Gazette a list of goods and services
for the time being subject to a price order or to a special
approval under Part II of the Control of Prices Act 1947:
And whereas it is provided in subsection (2) of the said
section 18 that on the publication of any notice under the
said subsection (1):
(a) Every price order and special approval shall be deemed
to be revoked to the extent to which it applies
to any goods or services not referred to in the
said list; and
(b) All goods and services not referred to in the said
list shall be deemed to be exempt from Part III
of the said Act:
And whereas the Minister is desirous of publishing in the
Gazette, pursuant to the said subsection (1), this notice
containing a list of goods and services for the time being
subject to a price order or to a special approval under
Part II of the said Act:
Now, therefore, the Minister pursuant to section 18 of
the said Act, hereby gives the following notice:

  1. This notice may be cited as the Control of Prices
    (Positive List) Notice 1974, and shall come into force on
    the 15th day of July 1974.
  2. The goods and services referred to in the Schedule
    hereto are subject to a price order or to a special approval
    under Part II of the said Act.
  3. The Control of Prices (Positive List) Notice 1973, and
    amendments to that notice are hereby revoked.
    SCHEDULE
    Building Materials
    Building boards in their primary state of manufacture
    (including wallboards of the Pinex and Gibraltar Board
    types, hardboard, and particle boards).
    Cement (New Zealand manufactured).
    Timber (New Zealand grown).
    Timber charges:
    Dressing.
    Drying, air or kiln.
    Measuring and gauging.
    Processing.
    Protective treatment.
    Sawing.
    Selecting.
    Chemicals and Chemical Substances
    Drugs and related commodities:
    Drugs and any other substances and mixtures of sub-
    stances specially prepared for use in the treatment,
    prevention, investigation, or alleviation of any disease,
    illness, or injury included in any drug tariff or amend-
    ment issued pursuant to section 99 of the Social
    Security Act 1964.
    Fertilisers:
    Inorganic fertilisers and ingredients, and fertiliser mixtures
    containing inorganic ingredients, except when sold
    retail in quantities less than 1 cwt or of less than
    10 gallons in the case of liquid fertilisers.
    Urea, blood and bone, dried blood and bone dust, except
    when sold retail in quantities less than 1 cwt.
    Petroleum products:
    Petrol.
    Diesel and fuel oil.
    Foodstuffs and Related Commodities
    Apples and pears sold by retailers.
    Bananas sold by retailers.
    Bread (except sold as part of a meal and bread sold in
    Stewart Island).
    Butter, manufactured in New Zealand, excluding butter
    when sold in portions not exceeding 1 oz.
    Canned foods and canned pet foods manufactured by
    persons whose annual turnover exceeds $1,000,000.
    Cigarettes, excluding cigars and cheroots.
    Eggs, hen and duck.
    Flour, including gluten, wheatmeal, and wholemeal, but
    excluding self-raising flour, soya bean, and rye flour,
    and also excluding wheatmeal and wholemeal in packs
    of 5 kg or less when sold by retailers and wholesalers
    other than the New Zealand Wheat Board or its agents.
