Decision of the Indecent Publications Tribunal
IN the matter of the Indecent Publications Act 1963, and
in the matter of a reference by the Magistrate's Court in
Auckland for a decision in respect of the books The Mouth
as a Sensual Trap by Lydia Wilkinson, published by Brandon
Books; The Swinging Singles Report by Thomas Eastwood,
published by Brandon Books; and With his Mother and
his Sister and Diana's Black Chauffeur by Michel Bourjade,
published by Montmatre Press.
There were no appearances and no submissions were made.
DECISION OF THE TRIBUNAL
THE first and second of these books purport to be "case
histories" and the third an original translation of a privately
printed French book.
Each is a collection of explicit and crudely written sexual
encounters devoid of any merit or honesty of purpose.
The Tribunal classifies each book as indecent.

Decision of the Indecent Publications Tribunal
IN the matter of the Indecent Publications Act 1963, and
in the matter of an application by Marketing Services (N.Z.)
Ltd., for a decision in respect of the magazines: New
Exclusive, Vol. 5, No. 7, 8, 9, and 10, published by Exclusive
Man, London.
Mr. P. J. Downey appeared on behalf of the applicant
and made submissions.
DECISION OF THE TRIBUNAL
A salient feature of the Act under which the Tribunal
operates is the attention that must be given to the effect
on the public good in determining the character of any
publication. The Tribunal must assess the public good with
due regard to changing conditions. This need is most apparent
in dealing with magazines of light entertainment, which, in
a very competitive market, are constantly adjusting their
content, style, and format to readers' tastes. The limits of
acceptability, likewise, are not static and over a period of
time may change considerably. The fundamental question
to be asked of the four issues of New Exclusive now before
the Tribunal is this: are these publications acceptable within
the criteria laid down by the Act for circulation in this
community at this time?
The answer in this instance can be readily given. The
text, photographs, and advertisements in the magazines con-
centrate on presenting sex in a crude and prurient way,
the special feature being a detachable poster-size centre-
fold of a provocatively posed female. There is nothing in
the magazines to complicate the simple, direct appeal they
make to vicarious indulgence in their parade of poses and
possibilities. The overall effect is to debase sex in a way
that the Tribunal judges to be harmful.
The Tribunal classifies these four issues as indecent.
