Declaring an Easement in Gross Over Land Taken for Stormwater Purposes in Block XVI, Cloudy Bay Survey District, Borough of Blenheim

PURSUANT to section 32 of the Public Works Act 1928, the Minister of Works and Development hereby declares that, a sufficient agreement to that effect having been entered into, an easement in gross is hereby taken for stormwater purposes over the land described in the Schedule hereto vesting in the Mayor, Councillors, and Citizens of the Borough of Blenheim from and after the 10th day of January 1974, the full and free right, liberty, licence, and authority in perpetuity to conduct and convey stormwater over, under, and along the said land; together with the further full and free rights, liberties, licences, and privileges in perpetuity hereinafter set forth, that is to say:

(a) The right to enter upon all or any of the said lands to lay, construct, reconstruct, repair, renew, inspect, cleanse, and maintain all necessary pipes together with all tobies, valves, and surface boxes of such internal diameter and of such material and at such depth as shall be necessary for the unimpeded conveyance of stormwater.

(b) The right to enter upon all or any of the said lands from time to time and all reasonable times by its servants, agents, and workmen, licensees and invitees with all necessary tools, implements, plant machinery, and vehicles for the purpose of laying, constructing, reconstructing, repairing, renewing, inspecting, cleansing, and maintaining all or any of the pipes, tobies, valves, and surface boxes.

(c) The right to dig and break up the surface of the said lands or any parts thereof and generally to do and perform all acts and things as may be necessary or proper for the unimpeded conveyance of storm-water.
