Notice of Intention to Take Land in Block X, Kairanga Survey District, City of Palmerston North, for State Housing Purposes

Notice is hereby given that it is proposed, under the provisions of the Public Works Act 1928, to execute a certain public work, namely, the development of land for State housing purposes as defined in the Housing Act 1955, and for the purposes of that public work the land described in the Schedule hereto is required to be taken; and notice is hereby further given that the plan of the land so required to be taken is deposited in the post office at Palmerston North, and is there open for inspection; that all persons affected by the execution of the said public work or by the taking of the said land should, if they have any objections to the execution of the said public work or to the taking of the said land, not being objections to the amount or payment of compensation, set forth the same in writing and send the written objection, within 40 days of the first publication of this notice, to the Minister of Works at Wellington and that, if any objection is made in accordance with this notice, a public hearing of the objection will be held unless the objector otherwise requires, and each objector will be advised of the time and place of the hearing.

Pursuant to section 29 of the Public Works Amendment Act 1948, the Minister of Works hereby proclaims as road the land described in the First Schedule hereto, which land shall vest in the Chairman, Councillors, and Inhabitants of the County of Bay of Islands, also proclaims as closed the road described in the Second Schedule hereto, also takes the land described in the Third Schedule hereto for the purposes of subsection (6) of the said section 29, and declares that the road described in the said Second Schedule, when so closed, and the land described in the said Third Schedule, when so taken, shall vest in Leslie Edward Tyree, of Kaeo, farmer, subject to statutory land charge A. 165930 and memoranda of mortgage A. 110617 and A. 385687, North Auckland Land Registry.
