Declaring Land Acquired for a Local Work to be Crown Land

A PROCLAMATION

PURSUANT to the Public Works Act 1928, I, Sir Edward
Denis Blundell, the Governor-General of New Zealand,
hereby declare the land described in the Schedule hereto
to be Crown land, subject to the Land Act 1948.


SCHEDULE

WELLINGTON LAND DISTRICT

ALL that piece of stopped road containing 1 acre 3 roods
3 perches situated in Block II, Sandy Survey District, adjoin-
ing part Section B, Rangitikei District, and Lot 3 and part
Lot 2, D.P. 7133, being part Section CXCIII, Rangitikei
District; as the same is more particularly delineated on the
plan marked M.O.W. 26407 (S.O. 27916) deposited in the
office of the Minister of Works at Wellington, and thereon
coloured green.

Given under the hand of His Excellency the Governor-
General, and issued under the Seal of New Zealand,
this 18th day of September 1973.

PURSUANT to the Public Works Act 1928, His Excellency the
Governor-General, acting by and with the advice and consent
of the Executive Council, hereby consents to the land described
in the Schedule hereto being taken for a pleasure ground.

Change of Rural Fire Authority for the Tuwharetoa Rural
Fire District and Revocation of Such District

At the Government Buildings at Wellington this 24th day of
September 1973

Present:

THE HON. H. WATT PRESIDING IN COUNCIL

PURSUANT to the Forest and Rural Fires Act 1955 and all
other powers so enabling, His Excellency the Governor-
General, acting by and with the advice and consent of
the Executive Council, hereby makes the following order:


O R D E R

  1. In accordance with a resolution to that effect duly
    passed on or about the 25th day of January 1973 (hereinafter
    called the transfer date) by the Tuwharetoa Rural Fire
    Committee (hereinafter called the Committee):

(a) From and including the transfer date the Committee
shall cease to be the Fire Authority in respect
of the Tuwharetoa Rural Fire District (hereinafter
called the district) constituted by an order made
on the 30th day of March 1949* (hereinafter together
with all amendments thereto referred to as the
principal order), so that the Minister shall thereupon
become and be the Fire Authority in respect of
the district constituted by the principal order;

(b) As from the transfer date, a certain landrover vehicle
used in fire fighting by Mr John Takakopiri Asher
as principal fire officer for the Committee over a
long period, shall be taken over by him.

  1. The principal order may hereafter be cited as the
    Tuwharetoa Rural Fire District Order 1949.

  2. Subject to a reservation of the authority of the Governor-
    General by Order in Council under section 7 (2) of the
    Forest and Rural Fires Act 1955 to make such further or
    other Order in Council as may from time to time seem
    to him to be desirable with respect to the property, liability,
    and engagement of the Committee in respect of the administra-
    tion of the district (including all matters outstanding as at
    the transfer date not disposed of by the Committee on
    or before the transfer date), the principal order is hereby
    revoked as at the date hereof, and the district is con-
    sequently abolished.

The Opotiki Borough Council Foreshore Control Order 1973

ORDER IN COUNCIL

At the Government Buildings at Wellington this 24th day of
September 1973

Present:

THE HON. H. WATT PRESIDING IN COUNCIL

PURSUANT to section 165 of the Harbours Act 1950, His
Excellency the Governor-General, acting by and with the
advice and consent of the Executive Council, hereby makes
the following order.


O R D E R

  1. (a) This order may be cited as the Opotiki Borough
    Council Foreshore Control Order 1973.
    (b) This order shall come into force on the date of its
    publication in the Gazette.

  2. In this order—

“The Act” means the Harbours Act 1950:
“The Council” means the Opotiki Borough Council:
“Foreshore” means such parts of the bed, shore, or banks
of a tidal water as are covered and uncovered by the
flow and ebb of the tide at ordinary spring tides:
“Minister” means the Minister of Transport, and includes
any officer, person, or authority acting by or under
the direction or authority of the Minister.

  1. There is hereby granted to the Council for a period of
    21 years from the commencement of this order, subject to
    the provisions of section 165 of the Act and to the condi-
    tions specified in the Second Schedule to this order, the
    control of the foreshore described in the First Schedule to
    this order.

FIRST SCHEDULE

ALL that area of foreshore abutting the Borough of Opotiki
excepting thereout the foreshore adjoining the eastern bank
of the Waioeka River extending from the southern boundary
of Duke Street to the northern side of the traffic bridge
off Forsyth Street.


SECOND SCHEDULE

CONDITIONS

(1) Her Majesty or the Governor-General and all officers
in the Government service acting in the execution of their
duty shall, at all times, have free ingress, passage, and egress
