Notice of Amendment to the Requirements for the Importation of Agricultural and Vegetable Seeds (Notice No. 556 Ag. 31005)
PURSUANT to the Introduction and Quarantine of Plants Regulations 1973, and the Stock Foods and Agricultural Seeds Importation Regulations 1958, the Director-General of Agriculture and Fisheries hereby gives the following notice.
NOTICE

Title—This notice may be cited as the Importation of Agricultural and Vegetable Seeds Notice 1973, Amendment No. 1 and shall be read together with and deemed part of the Importation of Agricultural and Vegetable Seeds Notice 1973 (Notice No. 513 Ag. 31005) published in the Gazette on Thursday, 12 July 1973, No. 66, p. 1330 (hereinafter referred to as the principal notice).

General consent—Clause 3 of the principal notice is hereby amended by adding the following words: “Consent has also been given to the importation of small packets of commercially packed vegetable, herb, or spice seed not exceeding two per cultivar, without the need of a health, veterinary, or purity analysis certificate (refer columns 9, 10, and 13 of Part A of the Schedule to the principal notice) provided that—
(i) The conditions for the seed given in the Schedule to the principal notice do not provide for an endorsed health certificate (excluding tomato seed); and
(ii) The seed originates from a country currently free from foot and mouth disease.”
- Schedule amended—(1) The explanatory note to the Schedule to the principal notice is hereby amended by adding to the item relating to column 9, the following words: “Where the seed is to be imported from any of the following countries, viz, U.K. (including Eire), Australia, Canada, U.S.A., or Japan, no veterinary certificate is required. If a ‘Yes’ appears in column 9 in respect of any item, this means that a veterinary certificate is only required when the seed is imported from countries other than those listed above.”
(2) Column 9 of Part A of the Schedule to the principal notice is hereby amended by replacing the word “Yes” with “No” in respect of the following items, viz—
Adzuki beans; Alsike clover; Asparagus seed; Aubergine (eggplant); Beans, adzuki; Beans, broad; Beans, dolichos; Beans, dwarf French, bush, etc.; Beans, haricot; Beans, mung; Beans, scarlet runner; Beans, soya, whole, for sowing; Beans, soya, crushed; Broad bean; Broccoli; Brussels sprouts; Bush bean; Cape gooseberry; Capsicum; Cauliflower; Chou moellier (marrow stemmed kale); Clover, alsike, from Australia; Clover, strawberry, from Australia; Clover subterranean, from Australia, including Tasmania; Cocksfoot, from U.K.; Cow pea; Crown vetch; Cucumber; Dolichos beans; Dwarf French beans; Egg plant; Endive; Flax; French white millet, for sowing or bird seed, from Australia only; Garlic; Gherkin, Haricot beans; Hungarian millet, from Australia for bird seed or sowing; Japanese millet, for sowing or bird seed, from Australia only; Marrow stemmed kale (chou moellier); Kapok; Leek, Linen flax; Linseed; Lucerne, from South Australia; Marrow; Marrow stemmed kale; Maw; Melon, all types; Millets, common, French white, Hungarian, Japanese, panicum, pearl, and sprays for sowing or bird seed, from Australia only; Mung bean for sowing; Mustard seed all types; Okra (bindi gumbo); Onion; Panicum millet from Australia, for bird seed or sowing; Pearl millet from Australia; Peas, all varieties, Phalaris tuberosa, from Australia; Poppy seed, for bird seed; Pumpkin; Radish; Rape; Scarlet runner bean; Sesame seed; Soya beans, whole, for sowing or consumption, from Australia; Soya beans, crushed from Australia; Squash; Strawberry clover, from Australia; Subterranean clover, from Australia including Tasmania; Swede; Tomato.
(3) Column 10 of Part A of the Schedule to the principal notice is hereby amended by replacing the symbol III with III(S); IIIA with IIIA(S), and IIIB with IIIB(S), where they occur, in respect of the times listed below—

(4) Part A of the Schedule to the principal notice is hereby further amended by the addition of the following items, in alphabetical order:

(5) Part A of the Schedule to the principal notice is hereby further amended in respect of the following items:
Castor beans, for processing, delete IIIC in column 9 and insert III.
Kapok, delete V from column 8, and insert I.
Millet, sprays, bulk; Millet, sprays in cellophane, delete “B” from column 10 in both cases, and 39 from column 11 in both cases.
Melon, add “all types” over columns 2 and 3, and delete botanical name “melo” and insert “spp”.
Penn cross bentgrass, add palustris to the botanical name in column 3.
Poppy, bird seed only, delete “Yes” from column 10 and insert III(S).
(6) Part B of the Schedule to the principal notice is hereby amended as follows:
(i) “Certificate No. III”—Add “(S)” so that new title of certificate reads “Certificate No. III(S)”.
(ii) Following “Certificate III(S)” and new “Certificate No. III—An International Health Certificate issued in accordance with the Introduction and Quarantine of Plants Regulations 1973”.
(iii) Add note following Certificate III—“The storage ‘(S)’ part of this certificate may be replaced by any of Certificates VIA (i), (ii), or (iii) at the importer’s option”.
(iv) Insert brackets round the work “further” in line 1 of both Certificate No. IIIA and Certificate IIIB.
(v) Delete all reference to Certificate IIIC.
(vi) Add the following diseases to the list of Endorsement Numbers:
“44. Smut (Ustilago tragopogonis—pratensis).
“24A. Dwarf bunt (Tilletia panicii).”
(vii) Delete items (i) and (ii) of “Certificate No. IV—Purity Analysis”, and insert the following—“A certificate issued by a Federal, State, Satellite, or other official registered seed testing station, stating that in a special search comprising not less than 60 grams on an officially drawn sample from an identified seed lot, the seed was found to be free from seeds of species prohibited under the New Zealand Introduction and Quarantine of Plants Regulations 1973, and the Noxious Weeds Act 1950, and its amendments. All impurities found must be stated on the certificate together with their rate of occurrence.”
