Mr Rabone and Mr Trendle appeared on behalf of the Police. Mr P. J. Downey put in written submissions on behalf of Seven Seas Publishing Pty. Ltd. subsequent to the hearing to which Mr Rabone made written submissions for the Police in reply.

DECISION AND REPORT

Hello Sex is a straightforward descriptive book of instruction on most aspects of human sexuality. The purpose of the book is stated in the opening sentence of the last chapter as being "intended to indicate the facts, and some of the problems, of becoming a sexually capable young person".

Mr Downey, in his submission correctly so, draws attention to the chapter on abortion and the fact that the law given in that chapter is the law that applies in England. The text of that chapter is well balanced and objective and a reader would probably realise that the legal position stated refers to the English law. We do not raise any objection to the book on this score.

The Tribunal does not basically find fault with the text of the book and, in fact, is of the view that taken as a whole the text is unobjectionable. But it is some of the photographs which are of concern to the Tribunal. Mr Rabone in his submission suggested these were chosen for their sensational and salacious appeal, and hence there was no honesty of purpose in their inclusion in the book. Some of the photographs, and in particular those on pages V, VI, and VII, are not strictly relevant to the text and in the view of the Tribunal are offensive and indecent. The photographs on the book cover are also deliberately designed to appeal to the prurient. Mr Downey submitted that they might be held to be objectionable by some people but that they are in accord with the general informative nature of the book and not given any undue emphasis. We cannot agree with this contention but rather with Mr Rabone who submitted that the photographs have no purpose other than to act as an inducement to beguile the customer to purchase the book.

We consider that the inclusion of some of the photographs in the book displays a lack of honesty of purpose on the part of the publishers. Section 11 (1) (f) of the Act requires us to take this fact into consideration.

The Tribunal classifies this book as indecent.

Decision of the Indecent Publications Tribunal

IN the matter of the Indecent Publications Act 1963, and in the matter of an application by the Comptroller of Customs for a decision in respect of the book Australian Golden Boys, Vol. 1, No. 1, published by Australian Golden Boys, Sydney, N.S.W., Australia.

Mr Bathgate appeared on behalf of the applicant and made submissions. There was no appearance of the publisher's representative in New Zealand.

DECISION OF THE TRIBUNAL

THIS collection of photos of nude males is said to be intended to provide reference studies for the artist and the art student in their studies of anatomy and the posing of the model. The Tribunal has had other publications featuring male nudes before it, some of which have been accepted as art studies, others rejected as encouraging homosexuality. This Australian publication has an emphasis on the penis that calls into question the honesty of purpose of the publishers. While the magazine does not have the more extreme character of some which have been rejected, it is dubious enough not to be entitled to circulate freely, and, because the material readily lends itself to improper use, an age restriction is inappropriate.

The Tribunal classifies this magazine as indecent.

IN the matter of the Indecent Publications Act 1963, and in the matter of an application by the Comptroller of Customs for a decision in respect of the magazine Rex, No. 5 published by Top Sellers Ltd., London.

Mr Bathgate appeared on behalf of the applicant and made submissions. There was no appearance of the publisher's representative in New Zealand.

DECISION OF THE TRIBUNAL

EXCEPT for a rather incongruous article on horse racing, the contents of this magazine consist of articles and illustrations in which sex is pushed at the reader in a way that is calculated to excite prurient gratification and to a degree that is objectionable.

The Tribunal classifies this magazine as indecent.

Hop Marketing Committee Election Notice (No. 535 Ag. 60546)

PURSUANT to clause II of the Schedule to the Hop Marketing Regulations 1939, notice is hereby given that the roll of those persons qualified to vote for the election of five producers' representatives on the Hop Marketing Committee will be open for inspection during ordinary office hours at the following places, viz: Ministry of Agriculture and Fisheries, Head Office, Wellington, and at Nelson; also at the following post offices, viz: Motueka, Upper Moutere, Wakefield, and Nelson.

The roll will be available for public inspection for a period of 7 days from 15 August 1973.

Nomination forms may be obtained on application to any of the above offices or from the Returning Officer, Ministry of Agriculture and Fisheries, Nelson. Nominations must be in the hands of the Returning Officer not later than noon on 14 September 1973.

PURSUANT to subsection (3) of section 23 of the Standards Act 1965, notice is hereby given that the following draft amendment is being circulated:
