Declaring a Drainage Easement Over Land Taken for Sanitary Works in the City of Hamilton

PURSUANT to section 32 of the Public Works Act 1928, the Minister of Works hereby declares that, a sufficient agreement to that effect having been entered into, the drainage easement described in the Second Schedule hereto is hereby taken for sanitary works over the land described in the First Schedule hereto, and shall vest in the Mayor, Councillors, and Citizens of the City of Hamilton from and after the 27th day of August 1973.

FIRST SCHEDULE

SOUTH AUCKLAND LAND DISTRICT

ALL that piece of land containing 12.5 perches situated in Block II, Hamilton Survey District, being part Lot 4, D.P. S. 1925; as the same is more particularly delineated on the plan marked M.O.W. 27167 (S.O. 47049) deposited in the office of the Minister of Works at Wellington, and thereon coloured yellow.

SECOND SCHEDULE

SOUTH AUCKLAND LAND DISTRICT

Description of Easement

THE full, free, and uninterrupted right, liberty, and licence for the Hamilton City Council (hereinafter referred to as “the grantee”) from time to time and at all times to drain, discharge, or convey sewage and other waste material and fluid in any quantities along, over, or under the land described in the First Schedule hereto and for that purpose to lay and maintain a line or lines of sewage pipes through and under the piece of land described in the said First Schedule, and secondly, in order to construct or maintain the efficiency of any such sewage pipes, the full, free, uninterrupted, and unrestricted right, liberty, and licence for the grantee, its surveyors, engineers, servants, agents, and workmen to enter upon the land described in the said First Schedule for the purpose of laying, inspecting, cleansing, repairing, maintaining, and renewing any such sewage pipes or any parts thereof and of opening up the soil of that land to such extent as may be necessary and reasonable.

PURSUANT to section 29 of the Public Works Amendment Act 1948, the Minister of Works hereby proclaims as road the land described in the First Schedule hereto, which land shall vest in the Chairman, Councillors, and Inhabitants of the County of Hawke’s Bay, and also hereby proclaims that the road described in the Second Schedule hereto is hereby closed, and shall, when so closed, vest in Russell Hilton Pettigrew, of Napier, transport operator, subject to mortgage No. 210144, Hawke’s Bay Land Registry; also hereby takes the land described in the Third Schedule hereto for the purposes of subsection (6) of the said section 29 and declares that such land shall, when so taken, vest in the said Russell Hilton Pettigrew, of Napier, transport operator, subject to mortgage No. 210144, Hawke’s Bay Land Registry.
