Tariff and Development Board Notice No. 361—Inquiry Concerning Protection for New Zealand Industry Producing Soya Beans of Tariff Item 12.01.400, Soya Bean Meal and Flour of Tariff Item 12.02.001, and Soya Bean Oil and Certain Other Vegetable Oils Included in Tariff Headings 15.07, 15.08 and 15.12

  1. In Tariff and Development Board Notice No. 349 (New Zealand Gazette, dated 19 April 1973) the Board advised that the taking of evidence affecting soya beans, of Tariff item 12.01.400, had been deferred and would be taken in conjunction with any evidence on soya bean oil at the public hearing scheduled to commence on 2 July 1973. At the time the request was made for the deferment of the hearing of the evidence on soya beans, the Board was also asked to include soya bean meal in the forthcoming inquiry. As it did not have this latter item currently under reference, the Board requested the Minister of Customs to add these goods to its current references and the Minister has now agreed to do so. Accordingly the Board has now included soya bean meal and flour of Tariff item 12.02.001 in the hearing set down for 2 July 1973.

  2. The purpose of this notice is to clarify the content of the public hearing set down for 2 July 1973 and it takes into account and supersedes the following earlier notices:

    Schedule E, Notice No. 323, New Zealand Gazette, dated 7 December 1972.
    Notice No. 340, New Zealand Gazette, dated 22 March 1973.
    Notice No. 349, New Zealand Gazette, dated 18 April 1973.

A revised list of the Tariff provisions pertaining to the forthcoming public hearing is set out in the attached Schedule to this notice. In the case of Notice No. 340, the reference to the proposed New Zealand production of soya bean oil still stands and applies similarly to soya beans and to soya bean meal and flour.

  1. For the purpose of taking evidence in respect of the goods set out in the attached Schedule the Board will hold a public hearing commencing at 2 p.m. on Monday, 2 July 1973, in the Hearing Room, Eighth Floor, Cumberland House, Upper Willis Street, Wellington.

  2. The public hearing will be conducted in three stages. Stage I, evidence relating to soya beans of Tariff item 12.01.400, will be taken at the commencement of the hearing; Stage II which will include evidence relating to soya bean meal and flour of Tariff item 12.02.001 and soya bean oil of Tariff items 15.07.001 and 15.07.009 will immediately follow Stage I; and Stage III, which will be heard after the completion of Stage II, will relate to the balance of the items included in the attached Schedule. Representations where possible should be prepared in conformity with this staging.

  3. Parties intending to make representations or requests about appropriate rates of customs duty are asked to take into account the statement by the Minister of Overseas Trade of 7 May 1973, about the phasing out of British preferences from the New Zealand Tariff. Copies of this statement can be obtained from the undersigned. In a letter dated 6 April 1973, the Minister of Trade and Industry indicated that, while Government has asked the Board to consider the question of a single tariff rate, for trade policy reasons the Board’s recommendations on this aspect will not necessarily be made public for the time being. Parties intending to make representations or requests about the exemption from import licensing of goods at present not so exempt are asked to take into account the statement in the 1972 Financial Statement (page 19) that “the Government has also decided that where the industry is to be exempted from import licensing there should be provision in appropriate cases for a phase-out period which in general will be for up to three years”.

  4. Any person who intends to tender evidence should lodge, in typewritten form, 14 copies of public evidence and 12 copies of confidential evidence, to be presented under oath at the public hearing, at the Board’s office no later than Monday, 11 June 1973. In preparing this evidence the “Notes for Information and Guidance of Interested Parties” prepared by the Board may be of assistance. Copies of these notes may be obtained from the Board’s office.
