Section 166, Omaka Registration District, situated in
Block XIV, Cloudy Bay Survey District, Marlborough R.D.,
and coloured orange on plan M.O.W. 26151 (S.O. 5006)
was taken for buildings of the General Government
(RNZAF residential accommodation):

And whereas the Public Trustee as executor and trustee
of the estate of Stanley Richardson Jackson, late of Blenheim
in New Zealand, farmer, deceased, aforesaid, was entitled
to compensation in respect of his interest in the said land:

And whereas the Minister of Works has previously assented
to the granting of a right of way over part of the land
described above, viz, an area of 3 roods, being part Lot 2,
D.P. 2563, being part Section 166, Omaka Registration
District, coloured blue on plan M.O.W. 26151 (S.O. 5006):

And whereas to fully implement the agreement to grant
the said right of way it is necessary to extend the right
of way over an area of 37 perches, being part Section 166,
Omaka Registration District, situated in Block XIV, Cloudy
Bay Survey District, Marlborough R.D., coloured orange
on plan M.O.W. 26981 (W.D.O. 37911), being part of the
land comprised in Proclamation No. 825, Marlborough
Registry, being land held for defence purposes, as part
satisfaction of the compensation aforesaid:

And whereas the said Public Trustee has agreed to accept
such grant of right of way in part satisfaction of the said
compensation:

Now, therefore, the Minister of Works hereby gives notice,
pursuant to section 97 of the Public Works Act 1928, that
he assents to the agreement hereinbefore referred to.

Act 1948, the Minister of Works hereby proclaims as road
the land described in the First Schedule hereto, which
land shall vest in the Chairman, Councillors, and Inhabitants
of the County of Bay of Islands; and also hereby proclaims
as closed the road described in the Second Schedule hereto;
which land shall, when so closed, vest in Te Waimate
