Pursuant to section 25 of the Public Works Act 1928, the Minister of Works hereby declares the land described in the Schedule hereto to be set apart, subject, as to the land first described in the Schedule hereto, to the fencing agreement contained in memorandum of transfer No. 543818, North Auckland Land Registry, and to Proclamation No. 16889, North Auckland Land Registry, defining the middle line of the Auckland-Kumeu Motorway, and subject, as to that part of Lot 5, D.P. 42202, contained in the area fifthly described in the Schedule hereto, to the building-line restriction contained in K51653, North Auckland Land Registry, and subject, as to those parts of Lots 1 and 2, D.P. 42202, contained in the area fifthly described in Schedule hereto, to the drainage easement created in and by memorandum of transfer No. 575966, North Auckland Land Registry, for State housing purposes from and after the 22nd day of January 1973.
