Commission of Inquiry into Maori Reserved Land

ORDER IN COUNCIL

To all to whom these presents shall come, and to:

BARTHOLOMEW SHEEHAN, of Rotorua, retired Judge of the Maori Land Court; ROLLAND O’REGAN, of Wellington, retired Surgeon; and GEORGINA TE HEUHEU, of Rotorua, Legal Practitioner:

GREETING:

WHEREAS it is desirable that inquiry be made into certain matters relating to the Maori reserved land administered by the Maori Trustee pursuant to the provisions of the Maori Reserved Land Act 1955:

Now, therefore, pursuant to the Commissions of Inquiry Act 1908, I, Sir Edward Denis Blundell, the Governor-General of New Zealand, acting by and with the advice and consent of the Executive Council, hereby appoint you, the said Bartholomew Sheehan, Rolland O’Regan, and Georgina te Heuheu to be a Commission to inquire into and report upon the administration of land beneficially owned by Maoris and vested in the Maori Trustee as reserved land under the Maori Reserved Land Act 1955, and upon the provisions of that Act, and in particular, having regard to the interests of the beneficial owners of the land and to the rights of existing lessees, to inquire into and report upon—

(a) Whether the administration of the land should be retained in the hands of the Maori Trustee; or should be transferred to the beneficial owners or some body comprising them or representing them; or should be otherwise dealt with:

(b) Whether the existing statutory powers of dealing with the land are satisfactory:

(c) Whether the existing statutory provision for the alienation of the interests of the beneficial owners of the land, including the provision for the acquisition by certain lessees of the freehold of the area leased is warranted or satisfactory:

(d) Whether the provisions of existing leases of the land as to rights of renewal, and as to the frequency of the review of rentals and the methods of reassessment of rentals are satisfactory:

(e) If it be reported that any existing system, practice, or circumstance is unsatisfactory, the action which should be taken to remedy the matter:

(f) If it be reported that any provision made in the existing law is unsatisfactory, proposals for the amendment of the law accordingly:
