NOTICE OF CEASING TO CARRY ON BUSINESS IN NEW ZEALAND
Pursuant to Section 405 of the Companies Act 1955

HILL SAMUEL LIFE ASSURANCE LTD. hereby gives notice that it intends to cease to have a place of business in New Zealand from and after the 15th day of March 1974.

NOTICE OF APPLICATION FOR APPROVAL OF SCHEME

IN the matter of the Charitable Trusts Act 1957, and in the matter of the estate of EMMA GILLIBRAND, late of Auckland, widow, deceased:

A. Whereas by her last will dated 1 September 1936 the above-named Emma Gillibrand, who died at Auckland on the 23 June 1937, gave all her property including the house at 49 Princes Street, Northcote, Auckland, to her executors upon trust for her children for life and thereafter to her trustees upon trust to establish a home for elderly women in poor circumstances to be called “The Emma Gillibrand Home for Women” upon conditions more particularly set out in her said will.

B. It is impracticable or inexpedient to carry out that charitable purpose and the amount available is inadequate therefor.

C. The trustees have applied to the Supreme Court of New Zealand for an order under Part III of the above-mentioned Act approving a scheme for the disposition of the said house and other assets remaining in her estate.

Now therefore notice is hereby given:

  1. The trustees of the will of the said Emma Gillibrand, deceased, have applied to the Supreme Court of New Zealand for an order approving a scheme for the disposition of the said house and assets whereunder—

(a) The said house shall be sold by public auction and the proceeds thereof along with other assets in the estate shall be used (i) in payment of all expenses of sale; (ii) in payment of any taxes or duty; (iii) in payment of costs and other expenses.

(b) The balance then available shall be paid to “The Presbyterian Social Service Association (Auckland) Incorporated” to be held by it upon trust to provide accommodation for aged and needy persons in premises to be known as “The Emma Gillibrand Lodge” to be erected upon land acquired or to be acquired by the said Association adjoining its present home and hospital known as the “Lady Allum Home and Hospital” at Napoleon Avenue, Milford, Auckland. Such accommodation to be for all purposes incorporated in and integrated with the said Lady Allum Home and Hospital, and upon and subject to the further conditions more particularly set out in the said scheme.

  1. Copy of the scheme has been filed in the Registry office of the Supreme Court at Auckland and may be inspected free of charge during the hours at which the Registry Office is open to the public.

  2. The said application has been set down for hearing before the Supreme Court Auckland at 10 o’clock in the forenoon on Tuesday, the 5th day of February 1974.

  3. Any person desiring to oppose the said scheme is required to give written notice of his intention so to do to the Registrar of the Supreme Court at Auckland and to the Attorney-General and to the Executors and Trustees not less than 7 clear days before the date set down for the hearing of the said application. Any such notice may be given to the Executors and Trustees by delivering the same to the offices of their Solicitors, Messrs. Churton, Brainsby & Hart, Third Floor, General Buildings, Shortland Street, Auckland.

BOROUGH OF TE KUITI

NOTICE OF INTENTION TO TAKE LAND

IN the matter of sections 25 and 27 of the Health Act 1956, and in the matter of section 25 of the Public Works Act 1928:

NOTICE is hereby given that the Te Kuiti Borough Council proposes, under the provisions of the above-mentioned Acts, to execute certain public works, namely, the erection and establishment of a sewerage treatment station and oxidation ponds on the lands described in the Schedule hereto, and for the purpose of such public works the said lands are and will require to be taken by the said Corporation, under the provisions of the above Acts, and notice is further given that a full and legal description of the lands so required is deposited in the offices of Low, Chapman, and Carter, Solicitors, King Street. Te Kuiti, and is open for inspection without fee during the office hours.

All persons affected by the execution of the said public works or by the taking of such land who have any well-grounded objections thereto must state their objections in writing and send their objections within 40 days from the first publication of this notice to the said solicitors, Low, Chapman, and Carter, King Street, Te Kuiti.

SCHEDULE

(i) All that parcel of land containing 1360 square metres, being Lot A on Survey Office Plan 47310, Hamilton Registry, and being part of the Block created by partition order of the Maori Land Court, dated the 15th day of February 1973, called Te Kumi A21A.

(ii) All that parcel of land containing 4980 square metres, being Lot E on Survey Office Plan 47310, Hamilton Registry, and being part of the Block created by consolidation order of the Maori Land Court, dated the 10th day of November 1936, called Te Kumi A29.

Both the said parcels of land are situated off Te Kumi Station Road near Te Kuiti.

BAY OF ISLANDS COUNTY COUNCIL

NOTICE OF INTENTION TO TAKE LAND FOR ROAD

NOTICE is hereby given that the Bay of Islands County Council intends, under the provisions of the Counties Act 1956, to execute a certain work, namely, a road, and for the purpose of such work the land described in the Schedule hereto is required to be taken pursuant to the Public Works Act 1928; and notice is further given that a plan showing the land proposed to be so taken is deposited at the office of the said Council, situated at Main Road, Kawakawa, and may there be inspected by all persons without fee during ordinary office hours.

All persons affected by the proposed work or by the taking of the said land and who have an objection thereto, not being an objection as to the amount or payment of compensation, must state their objections in writing and send the same to the County Clerk, Bay of Islands County Council, P.O. Box 11, Kawakawa, so as to reach him not later than 21 January 1974, being 40 days after the first publication of this notice. If any objection is received a public hearing of the same will be held unless the objector otherwise requires and each objector will be advised of the time and place of such hearing.
