SCHEDULE

ALL those interests consisting of rights of way over part Lot 1 on Deposited Plan No. 4197, being part Allotment 106, Town of Hamilton West, comprising 144 square metres, more or less, and being part of the land described in certificate of title, Volume 136, folio 64, South Auckland Registry, as the same is more particularly delineated on Plan No. P. G5/051B lodged for inspection at the offices of the Hamilton City Council, and thereon coloured sepia, and being situated on the eastern corner of Ward and Barton Streets, Hamilton, such rights of way being appurtenant to the following pieces of land:

Description

1. The leasehold interest in those pieces of land comprising 34.65 perches, more or less, being Lots 2, 3, and 4, D.P. 4197, being the land described in memorandum of lease No. S. 520135.

2. The leasehold interest in those pieces of land comprising 23.12 perches, more or less, being Lots 5 and 6, D.P. 4197, being the land described in memorandum of lease No. S. 534754.

3. The leasehold interest in that piece of land comprising 12.89 perches, more or less, being Lot 9, D.P. 4197, being the land described in memorandum of lease No. S. 9670.

NOTICE OF INTENTION TO TAKE LAND

IN the matter of the Public Works Act 1928, and the Municipal Corporations Act 1954, and their respective amendments:

NOTICE is hereby given that the Wellington City Council proposes under the provisions of the above-named Acts and all other Acts, powers, and authorities enabling it in that behalf, to execute a certain public work, namely, for Municipal Reserve at Brosnahan Terrace and Holloway Road in the City of Wellington, and for the purpose of that public work the land described in the Schedule hereto is required to be taken, and notice is hereby further given that a plan of the land which is required to be taken is deposited in the public office of the Town Clerk to the said Council in the Municipal Offices Building, Mercer Street, in the said city, and is there open for inspection without fee by all persons during ordinary office hours, and that any person affected by the execution of the said public work or the taking of the said land should, if he has any objection to the execution of the said public work or to the taking of the said land, not being an objection to the amount or payment of compensation, send his written objection within 40 days from the first publication of this notice to the Wellington City Council, addressed to the Town Clerk at his said office, and notice is hereby further given that if any objection is made as aforesaid a public hearing of that objection will be held unless the objector otherwise requires and each objector will be advised of the time and place of that hearing and at that hearing each objector will be advised of the reason for the proposed taking.

ALL that piece of land containing 7 acres 2 roods 23.97 perches being—

Firstly, all that piece of land containing 5 acres 1 rood 38.68 perches, being part Section 10, Ohir0 District, and being all the land in certificate of title, Volume 568, folio 231, Wellington Registry, together with right of way created by conveyance 51051, the title being limited as to parcels.

Secondly, all that piece of land containing 2 acres and 25.29 perches, being part Section 10, Ohir0 District, and being also part of the land shown on Deposited Plan No. A2182 and Lots 1, 2, and 3 on Deposited Plan 5855, and being all the land in certificate of title, Volume 568, folio 165, Wellington Registry, subject to Order in Council 589 and to building-line restriction.

The land is situated at the western end of Holloway Road on its northern side, from Brosnahan Terrace to the end of Holloway Road.

NOTICE OF INTENTION TO CHANGE THE PURPOSE FOR WHICH LAND WAS ACQUIRED

IN the matter of the Public Works Act 1928 and the Municipal Corporations Act 1954, and their respective amendments:

NOTICE is hereby given that the Wellington City Council proposes, under the provisions of the above-named Acts and all other Acts, powers, and authorities enabling it in that behalf, to change the purpose for which the land described in the Schedule hereto was acquired (namely, for the purposes of a waterworks) to some other purpose (namely, housing purposes).

And notice is hereby further given that a plan of the said land is deposited in the public office of the Town Clerk to the said Council in the Municipal Offices Building, 5 Mercer Street in the said city, and is there open for public inspection without fee, by all persons during ordinary office hours, and that all persons objecting to the proposal are required to lodge their objections in writing at the offices of the said Town Clerk within forty (40) days from the first publication of this notice, and that a date and time for the hearing of such objections will be notified to all objectors in due course.
