CHARITABLE TRUSTS ACT 1957

IN THE MATTER of the Charitable Trusts Act 1957, and IN THE
MATTER of THE ESTATE OF ANNIE MARIE LEACH RUMBLE,
formerly of Stratford, widow, deceased.
NOTICE is hereby given pursuant to section 36 of the above-
mentioned Act that HUGH DOUGLAS THOMSON, of Stratford,
Solicitor, and DAVID SPENCE THOMSON, also of Stratford, Min-
ister of the Crown, as trustees of the estate have applied to the
Supreme Court for the approval of a scheme prepared under
section 34 of the said Act for the disposition as hereinafter
mentioned of the property held by the above-mentioned trust-
ees pursuant to the will of ANNIE MARIE LEACH RUMBLE upon
trust for the Royal New Zealand Institute of Horticulture (In-
corporated) the said trust being impossible or impracticable or
inexpedient to carry out for the purposes stated in such trust.
Particulars of the said scheme are as follows:
The property held by the trustees as aforesaid upon the trust
provided in the said will shall be applied for the following
purposes.

  1. There shall be a trust established for the benefit of the
    Stratford District and its environs in the Dominion of New
    Zealand and the said trust shall be known as "The Annie
    Rumble Trust" (hereinafter referred to as "the Trust").
  2. The capital of the Trust shall comprise the realised assets
    of a bequest made for the benefit of the Royal New Zealand
    Institute of Horticulture (Incorporated) by the late Annie
    Marie Leach Rumble formerly of Stratford, widow, together
    with any accrued income from the said assets and such other
    funds or assets as the Trust Board of the Trust shall in its
    absolute discretion approve for addition to the said assets and
    the said accrued income.
  3. The income of the Trust shall be derived from the invest-
    ment of the capital of the Trust pursuant to the Trustee Act
    1956 and its amendments.
  4. The Trust Board of the Trust shall be the Dominion Coun-
    cil of the Royal New Zealand Institute of Horticulture (herein-
    after referred to as "the Trust Board") and the Secretary for
    the time being of the said Dominion Council shall be the
    Secretary of the Trust Board.
  5. The objects of the Trust shall, subject to the conditions,
    terms, and provisions hereinafter contained or implied, be as
    follows:
    A. To make from the accumulated income of the Trust
    educational grants to horticulturists, horticultural students, and
    trainees, and other workers in horticulture with the intention
    that such persons may be assisted:
    (a) To advance their horticultural studies generally;
    (b) To undertake original research in horticulture;
    (c) To travel overseas to pursue horticultural studies or
    undertake horticultural research; or
    (d) To undertake any particular work for the advancement
    of horticulture in the Dominion of New Zealand.
    B. To make from the accumulated income of the Trust grants
    to organisations in the Borough or County of Stratford the
    objects of which accord with the objects of the Royal New
    Zealand Institute of Horticulture for such work in horticulture
    as shall be approved by the Electing Committee hereinafter
    constituted.
  6. Educational grants as hereinbefore provided shall be made
    to persons who:
    (a) Shall at one time or another have resided in the Borough
    or County of Stratford or in adjacent Boroughs or
    Counties or shall have attended any post-primary
    school in or adjacent to the Borough of Stratford; and
    (b) Shall have the express desire to pursue studies or research
    in horticulture.
    Provided however that no grant shall be made to a person other
    than a resident or former resident of the Borough or County of
    Stratford without the consent of the Stratford representative on
    the Electing Committee hereinafter constituted.
  7. All educational and other grants shall, pursuant to the
    provisions, terms, and conditions herein contained, be approved
    by the Trust Board on the recommendation of an Electing Com-

mittee comprising six persons, namely: (a) the President for
the time being of the Royal New Zealand Institute of Horticul-
ture (ex officio) or his nominee; (b) the Chairman for the
time being of the Examining Board of the said Institute; and
(c) four persons who shall represent the Stratford Borough
and County and who shall be appointed annually by the North
Taranaki District Council of the said Institute.
8. It shall be the duty of the said Electing Committee in its
discretion, but subject to the provisions, terms, and conditions,
herein contained, to call applications for grants from the accu-
mulated income of the Trust.
9. Upon the establishment of the Trust as herein provided
the income from the capital of the Trust shall be accumulated
until such income exceeds $2,000.00 at which stage the said
Electing Committee shall call for and consider applications for
grants as herein provided and shall recommend to the Trust
Board such distribution of the accumulated income as may be
appropriate in the circumstances.
10. The said Electing Committee shall meet at least once
in every year but additional meetings may be called at the
discretion of the Chairman of the Committee.
11. A quorum at meetings of the said Electing Committee
shall be three members.
12. The Chairman of the said Electing Committee shall be
appointed by the Committee annually from its own member-
ship and he shall have a casting vote.
13. The bankers of the Trust shall be the bankers of the
Royal New Zealand Institute of Horticulture.
The said scheme and the Attorney-General's report thereon
have been filed in and may be inspected at the offices of the
Supreme Court at New Plymouth.
The date proposed for the hearing of the application to
approve the said scheme is Friday, the 2nd day of June 1972.
Any person desiring to oppose the said scheme is required to
give written notice of his intention to do so to the Registrar of
the Supreme Court at New Plymouth and to the trustees (whose
address for service is at the offices of Messrs Moss and Co.,
Solicitors, 4 Devon Street East, New Plymouth) and also to the
Attorney-General not less than 7 days before the said date pro-
posed for the hearing of the application.

NOTICE OF INTENTION TO TAKE LAND

NOTICE is hereby given that it is proposed under the provisions
of the Public Works Act 1928 to take the land described in the
Schedule hereto for harbour works, namely harbour reclama-
tion and harbour improvement; and notice is further hereby
given that the plan of the land so required to be taken is
deposited in the offices of the Northland Harbour Board,
Quay Street, Whangarei, and is there open for inspection;
that all persons affected by the execution of the said public
work or by the taking of the said land should, if they have
any objections to the execution of the said public work or to
the taking of the said land, not being objections to the amount
or payment of compensation, set forth the same in writing
and send the written objection within 40 days of the first
publication of this notice to the Secretary of the Northland
Harbour Board, and that, if any objection is made in
accordance with this notice, a public hearing of the objection
will be held, unless the objection otherwise requires, and each
objector will be advised of the time and place of the hearing.
