the matter of an application by the Comptroller of Customs
for a decision in respect of the book La Libre, anonymous,
published by International Rakes Ltd., U.S.A.

There was no appearance of the applicant nor of the
publisher’s representative in New Zealand. Accordingly no
submissions were made.

DECISION OF THE TRIBUNAL

THIS book is quite devoid of any standards of decency in text
or illustrations. It acknowledges no author and the format,
binding, and production are the cheapest possible. The stories—
there are three of them with no indication of where they begin
or end—are grossly told accounts of sexual episodes and
perversions with no pretence of plot or character. The illustra-
tions have no relevance to the text.

The Tribunal classifies this book as indecent.

publisher’s representative in New Zealand. Accordingly no
submissions were made.

DECISION OF THE TRIBUNAL

THE introduction to this novel is a quotation from the works
of Havelock Ellis dealing with the relationship of pain and
love in sexual psychology. This is a cover for a sadistic story
exploiting masochism, cruelty, and sexual perversion as its
main themes. The book, in the view of the Tribunal, has no
redeeming features and deals with sex and violence in a manner
which clearly violates the Act.

The Tribunal classifies this book as indecent.

IN the matter of the Indecent Publications Act 1963, and in
the matter of an application by the Comptroller of Customs
for a decision in respect of the magazine Playboy, Vol. 19,
No. 1, January 1972.

There was no appearance of the applicant. Mr Heron,
solicitor, appeared on behalf of the publishers and made
submissions.

DECISION OF THE TRIBUNAL

WE have considered earlier copies of Playboy and we repeat
what we said in decision No. 254 that the issue now before us
does not seem to be substantially different in content or
presentation from those issues already exonerated by the
Tribunal.

We find it difficult to understand why the Customs Depart-
ment should submit this magazine to us without making a
submission as to how this particular copy differs from those
previously exonerated.

The Tribunal classifies this magazine as not indecent.
