A PROCLAMATION
Pursuant to subsection (6) of section 5 of the Education Lands Act 1949, I, Sir Arthur Espie Porritt, Baronet, the Governor-General of New Zealand, hereby proclaim and declare that the land described in the Schedule hereto, being an area vested in the Nelson Education Board as a site for a school, shall be vested in Her Majesty the Queen, freed and discharged from every educational trust affecting the same, but subject to all leases, encumbrances, liens, or easements affecting the same at the date hereof.
SCHEDULE
NELSON LAND DISTRICT—BULLER COUNTY
Sections 51, 52, 53, 54, 55, 58, 59, and 60, Town of Millerton, situated in Block VI, Ngakawau Survey District: area, 2 acres, more or less (S.O. Plan 4810L).
Also Sections 56 and 57, Town of Millerton, situated in Block VI, Ngakawau Survey District: area, 2 roods, more or less (S.O. Plan 4810L).
Given under the hand of His Excellency the Governor-General, and issued under the Seal of New Zealand, this 24th day of February 1972.

The Mount Roskill Borough Council Foreshore Order 1972

ORDER IN COUNCIL
At the Government Buildings at Wellington this 21st day of February 1972
Present:
The Right Hon. J. R. MARSHALL PRESIDING IN COUNCIL
Pursuant to section 165 of the Harbours Act 1950, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.
ORDER

  1. (a) This order may be cited as the Mount Roskill Borough Council Foreshore Order 1972.
    (b) This order shall come into force on the date of its publication in the Gazette.
  2. In this order—
    "The Act" means the Harbours Act 1950;
    "The council" means the Mount Roskill Borough Council;
    "Foreshore" means such parts of the bed, shore, or banks of a tidal water as are covered and uncovered by the ebb and flow of the tide at ordinary spring tides;
    "Minister" means the Minister of Marine and Fisheries; and includes any officer, person, or authority acting by or under the direction or authority of the Minister.
  3. There is hereby granted to the council for a period of 21 years from the commencement of this order, the control of foreshore described in the First Schedule to this Order, subject to the provisions of section 165 of the Act, and to the conditions specified in the Second Schedule to this order.
    FIRST SCHEDULE
    DESCRIPTION OF FORESHORE
    All the foreshore at Wattle Bay, Manukau Harbour, as shown marked in red on plan M.D. 14482.
    SECOND SCHEDULE
    CONDITIONS
  4. Her Majesty or the Governor-General and all officers in the Government service acting in the execution of their duty shall, at all times, have free ingress, passage, and egress, into, over, and out of the foreshore described in the First Schedule to this order.
  5. Nothing in this order shall authorise the council to do or cause to be done anything repugnant to or inconsistent with any law relating to the Customs or any provisions to the Harbours Act 1950 that is or may hereafter be in force.
  6. The rights, powers, and privileges conferred by this Order in Council shall not apply to those portions of the foreshore required for securing the shore ends of any telegraph cables that are at present or may be at any time laid down within the area of foreshore described in the First Schedule to this order.
