DECISION OF THE TRIBUNAL

THESE 9 books are curious productions. Each has a slight text giving banal trivia from the world of sexual fantasy and aberration that some of the titles suggest. The larger part of each book consists of grossly suggestive photographs in some of which the genitalia are painted over or masked by stars. The effect of this device is to heighten the grotesqueness and crudity of the photographs. In some of the books the title, the text, and the photographs have no relationship to one another and the photographs have an air of utter unreality. These books do not appear to have any honesty of purpose but seem to have been produced as straight pornography.

The Tribunal classifies these books as indecent.

Decision of the Indecent Publications Tribunal

IN the matter of the Indecent Publications Act 1963, and in the matter of an application by the Comptroller of Customs for a decision in respect of the book Older Women and Younger Girls by Ward Cleaver, published by Bens Books Ltd., London.

There was no appearance of the applicant. Mr Downey, solicitor, appeared on behalf of the intended importer but did not make submissions.

DECISION OF THE TRIBUNAL

THIS book contains a certain amount of text very little of which is of any value. The two models are nude except for slight genital coverings. Three models are shown on the cover in full colour, engaged in lesbian contact. The purpose of the book appears to be to exploit prurient curiosity. It could do no good and might do harm.

The Tribunal classifies this book as indecent.

Decision of the Indecent Publications Tribunal

IN the matter of the Indecent Publications Act 1963, and in the matter of a reference to the Tribunal under section 12 (1) of the said Act by the Magistrate’s Court at Wellington for a decision and report in terms of the said section in respect of the following books: Lesbian Possessed by William Charles Spatari, Flesh Merchants by James Bryan, Three Little Lesbians by Tony Trelos, and The Body Dealer by Charles Richards, all published by Brandon House, California. High School Hotbed by Jan Cheux, published by Cameo Library, California. Stud by Thomas Shire, The Hitch-hiker by H. R. Kaye, Portrait of a Lesbian by Samantha Golden, and Suddenly Wonderfully Gay by Peter Kanto, all published by Brandon House, California. Swap Street Revisited by Robert H. Sheldon, published by Cameo Library, California. The Rape Machine by Ann Taylor, published by Brandon House, California. The Waitress by Cora Miller, published by Cameo Library, California. Lessons in Seduction by Michel Millot, published by Brandon House, California.

Mr E. B. Wallis, the intended importer, appeared and made submissions.

DECISION AND REPORT

THE first-named 11 books can be grouped together. There are some minor differences of quality among these books. What they share is the intention of exploiting morbid sexual interest through the fictional portrayal of various forms of sexual activity.

They demonstrate in their grossly exaggerated incidents, their exclusion of any experience that is not sexual, their reduction of human relationships to the juxtaposition of organs and their crude, repetitive language, the worst kind of commercial pornography. No book in this group has any element that would require qualification of the view the Tribunal takes of them as blatantly indecent.

The Tribunal classifies these books as indecent.

The book The Waitress is written at a slightly higher level. A girl becomes involved in big-city vice but remains essentially innocent and returns to her small-town sweetheart. Although crude and unedifying the book is by no means so gross as to make us feel that the law requires us to deprive adult persons of the choice of whether or not they may read it. Some restriction, however, is necessary if the purposes of the statute are to be fulfilled and accordingly we impose a partial restriction.

The Tribunal classifies this book as indecent in the hands of persons under the age of 18 years.

The book Lessons in Seduction is claimed to be a translation of a seventeenth century work. It consists of two long dialogues in which the processes of sexual intercourse are debated at tedious length. There is nothing violent or perverted in the behaviour described but the nature and tone of the material make it unsuitable for younger readers.

The Tribunal classifies this book as indecent in the hands of persons under the age of 18 years.

Decision of the Indecent Publications Tribunal

IN the matter of the Indecent Publications Act 1963, and in the matter of an application by the Comptroller of Customs for a decision in respect of the book Call Girl by Gilbert Oakley, D.PSY., published by Gold Star Publishers (Aust.) Pty. Ltd.

There was no appearance of the applicant. Mr Downey, solicitor, appeared on behalf of the publisher’s representative in New Zealand and made submissions.

DECISION OF THE TRIBUNAL

THE title of this paperback is rather misleading—it deals with all forms of prostitution. The publishers claim that it is a serious study of the emotional and functional aspects of prostitution but in fact it is little more than a stringing together of the remarks and experiences (real or assumed) of a variety of prostitutes and call girls, pre and post Wolfenden.

We do not ban the book altogether but its contents and presentation make it quite unsuitable for younger persons.

The Tribunal classifies this book as indecent in the hands of persons under the age of 18 years.

PURSUANT to section 23 of the Standards Act 1965, the Standards Council, on 17 December 1971, amended the undermentioned standard specification by the incorporation of the amendment shown hereunder:
