Price Order No. 2178 (Bread)

PURSUANT to the Control of Prices Act 1947, the Price Tribunal
hereby makes the following price order:

PRELIMINARY

  1. This order may be cited as Price Order No. 2178 and shall
    come into force on the 11th day of November 1971.

APPLICATION OF THIS ORDER

  1. (1) This order applies to that kind or class of bread (other
    than bread subject to Price Order No. 2177) sliced or unsliced,
    which is enclosed and securely wrapped at the bakehouse in
    clean unused paper and which was sold, before the 11th day of
    November 1971, atβ€”
    (a) A wholesale selling price of 10 percent less than the
    retail selling price; and
    (b) A retail selling price not exceeding 16 cents per loaf.
    (2) This order does not apply to bread sold on Stewart
    Island.

FIXING MAXIMUM WHOLESALE AND RETAIL PRICES OF BREAD
TO WHICH THIS ORDER APPLIES

  1. Subject to the provisions of this order, the maximum
    wholesale and retail selling prices which may be charged or
    received for any bread of the kind or class to which this
    order applies shall be as follows:
    (a) For sales by way of 17 cents per loaf less 10
    wholesale (see clause percent.
    4 below)
    (b) For sales by way of 17 cents per loaf.

  2. The wholesale price fixed by this order applies to bread
    delivered to the retailer's premises. In any case where bread
    is not so delivered the price shall be such as is agreed upon
    between the baker and the retailer, or failing such agreement,
    as may be approved by the Tribunal.

BOOKING FEE

  1. In addition to the price fixed by clause 3 (b) of this
    order a retailer may charge a booking fee at the rate of one
    half cent (Β½c) per loaf in respect of any bread of the kind or
    class to which this order applies if that bread is not paid for
    before, or at the time of, the customer's taking delivery of the
    bread at the shop.

SPECIAL PRICES WHERE EXTRAORDINARY CHARGES INCURRED

  1. Notwithstanding anything in the foregoing provisions of
    this order, and subject to such conditions, if any, as it thinks
    fit, the Tribunal, on application by any wholesaler, or retailer,
    may authorise special maximum prices in respect of any bread
    of the kind or class to which this order applies where special
    circumstances exist or for any reason extraordinary charges
    (freight or otherwise) are incurred by the wholesaler or
    retailer. Any authority given by the Tribunal under this clause
    may apply with respect to a specified lot or consignment of
    bread or may relate generally to all bread sold by the whole-
    saler or retailer, while the approval remains in force.
