The Control of Prices (Positive Lists) Notice 1971, Amendment
No. 2
PURSUANT to the Control of Prices Act 1947, the Minister of
Industries and Commerce hereby gives the following notice:

  1. This notice may be cited as the Control of Prices
    (Positive Lists) Notice 1971, Amendment No. 2, and be read
    together with, and deemed to be part of, the Control of Prices
    (Positive Lists) Notice 1971 (hereinafter referred to as the
    principal notice).
  2. This notice shall come into force on the day after the date
    of its publication in the Gazette.
  3. The principal notice is hereby amended by adding to that
    part of the Schedule described as "List of Goods and Services
    Included in the Control of Prices (Positive List) Notice 1966
    and Amendments Thereto (as at 14 February 1971)" under
    the subheading "Anthelmintic Drenches" the following descrip-
    tion:
    "Anthelmintic drenches specified in such Schedule as may
    be published in the Gazette from time to time by the
    Minister of Agriculture pursuant to the Department of
    Agriculture Act 1953."

    Price Order No. 2162 (Anthelmintic Drenches)
    PURSUANT to the Control of Prices Act 1947, the Price Tribunal
    hereby makes the following price order:
  4. This order may be cited as Price Order No. 2162 and
    shall come into force on the 28th day of June 1971.
  5. (1) Price Order No. 2161 is hereby revoked.
    (2) The revocation of the said order shall not affect the
    liability of any person for any offence in relation thereto
    committed before the coming into force of this order.
  6. In this order "prevailing price" means, in relation to the
    sale of those anthelmintic drenches described in clause 4 of
    this order, the price at which each such anthelmintic drench
    was sold by the same vendor on 10 June 1971, or, if no sale
    was made on that date, on the last preceding date on which any
    such sale was made by the vendor, subject to the same terms
    and conditions.
    APPLICATION OF THIS ORDER
  7. This order applies with respect to all sales of anthelmintic
    drenches specified in such Schedule as may be published in the
    Gazette from time to time by the Minister of Agriculture
    pursuant to the Department of Agriculture Act 1953.
    FIXING MAXIMUM PRICES OF ANTHELMINTIC DRENCHES
  8. Subject to the provisions of this order the maximum price
    that may be charged:
    (a) To a retailer on and after the 28th day of June 1971 for
    any anthelmintic drench the subject of this order,
    shall be the prevailing price, as defined in clause 3 of
    this order, to a retailer, reduced by 43½ percent;
    (b) To a user on and after the 28th day of June 1971, for
    any anthelmintic drench the subject of this order,
    shall be the prevailing price, as defined in clause 3
    of this order, to a user, reduced by 40 percent.
    SPECIAL PRICES WHERE EXTRAORDINARY CHARGES INCURRED
  9. Notwithstanding anything in the foregoing provisions of
    this order, and subject to such conditions, if any, as it thinks
    fit, the Tribunal, on application by any vendor of anthelmintic
    drenches to which this order applies, may authorise special
    prices in respect of any anthelmintic drenches to which this
    order applies, where special circumstances exist or, for any
    reason, extraordinary charges (freight or otherwise) are
    incurred by such vendor. Any authority given by the Tribunal
    under this clause may apply with respect to a specified lot or
    consignment of anthelmintic drenches, or may relate generally
    to all anthelmintic drenches to which this order applies sold
    by such vendor while the approval remains in force.
