Declaring Land Taken for Road in Block II, Titirangi Survey District, Waitemata County

PURSUANT to section 32 of the Public Works Act 1928, the Minister of Works hereby declares that, a sufficient agreement to that effect having been entered into, the land described in the Schedule hereto is hereby taken for road from and after the 24th day of May 1971.

ALL that piece of land containing 17 perches situated in Block II, Titirangi Survey District, North Auckland R.D., being part Lot 1, D.P. 36537; as the same is more particularly delineated on the plan marked M.O.W. 25110 (S.O. 46791) deposited in the office of the Minister of Works at Wellington, and thereon coloured yellow.

Declaring Land and Batter Easement Over Land Taken for the Auckland Harbour Bridge in the City of Auckland

PURSUANT to section 32 of the Public Works Act 1928, the Minister of Works hereby declares that, a sufficient agreement to that effect having been entered into, the land described in the First Schedule hereto and the batter easement described in the Second Schedule hereto over the land described in the Third Schedule hereto are hereby taken for the Auckland Harbour Bridge and shall vest in the Auckland Harbour Bridge Authority from and after the 24th day of May 1971.

SECOND SCHEDULE

NORTH AUCKLAND LAND DISTRICT

An easement in gross in perpetuity creating the full, free, uninterrupted, and unrestricted liberty and privilege for the Auckland Harbour Bridge Authority, its successors, and assigns, from time to time and at all times hereafter to remove soil and cut back the slope to form and construct a batter sufficient for the Authority's purpose in connection with the construction of the Auckland Harbour Bridge approaches over all those parcels of land described in the Third Schedule hereto, and for that purpose from time to time and at all times hereafter as occasion shall require the Auckland Harbour Bridge Authority by itself, its contractors, and subcontractors, and its and their servants, agents, and workmen to enter with vehicles laden or unladen and with derricks, machinery, and tools upon the said land and to erect all plant erections and works whether permanent or temporary thereon and to view the state and condition thereof or any parts thereof and to maintain, renew, conserve, and/or repair the batter or any part thereof subject to the following covenants:

(a) That the respective owners of the several pieces of land hereinafter described, their executors, administrators, and assigns shall not at any time make erections thereon without the previous consent in writing of the Auckland Harbour Bridge Authority.

(b) That the respective owners of the several pieces of land hereinafter described, their executors, administrators, and assigns, shall refrain from doing anything thereon or upon any portion of the land adjoining owned by them that may tend to endanger the batter or any part thereof or any structures or supports thereon whether by the drainage or leading of water thereon or there through or by any other action whatsoever.

(c) That the Auckland Harbour Bridge Authority, its successors, and assigns may erect and construct such batter on the land hereinafter described as it deems necessary for the construction of the Auckland Harbour Bridge approaches provided however that such erection and construction shall conform and be in accordance with modern and proved engineering methods and that it will face the batter or cutting away in such places as it considers necessary with a crib wall and do other such work which in the opinion of the Auckland Harbour Bridge Authority is considered necessary in the circumstances and will erect on the south-western boundary of the said land a suitable and sufficient rail and mesh fence of such height as would normally exclude the possibility of any danger or accident and will at all times maintain and keep such fence in good order and repair.

(d) That the Auckland Harbour Bridge Authority, its successors, and assigns shall refrain from carrying out any work or construction on the land hereinafter described which may be likely to cause any damage to any part of any adjoining land not included in this easement whereby the same may crack, slip, crumble, or fall away or otherwise howsoever and will at all times keep the owners thereof indemnified against any such damage which may be caused as a result of the construction of the batter.

(e) That the Auckland Harbour Bridge Authority, its successors, and assigns shall at all times keep the land hereinafter described in neat and tidy order.
