Declaring Land Taken for Christchurch Southern Motorway in the City of Christchurch

Pursuant to section 32 of the Public Works Act 1928, the Minister of Works hereby declares that, a sufficient agreement to that effect having been entered into, the land described in the Schedule hereto is hereby taken for Christchurch Southern Motorway from and after the 1st day of March 1971.

ALL that piece of land containing 29.3 perches situated in the City of Christchurch, Canterbury R.D., being Lot 2, D.P. 8783, part of Rural Section 154. All certificate of title, Volume 440, folio 148, Canterbury Land Registry.

Declaring an Easement Over Land Taken for the Auckland Harbour Bridge in the Borough of Northcote

Pursuant to section 32 of the Public Works Act 1928, the Minister of Works hereby declares that, a sufficient agreement to that effect having been entered into, the right of way easement described in the First Schedule hereto is hereby taken for the Auckland Harbour Bridge over the land described in the Second Schedule hereto, and shall vest in the Auckland Harbour Bridge Authority as from the date herein-after mentioned, and also declares that this Declaration shall take effect on and after the 1st day of March 1971.

FIRST SCHEDULE

NORTH AUCKLAND LAND DISTRICT
(Description of Easement)
An easement in gross in perpetuity (and without in any way limiting or detracting from the easement created by transfer 625870) being a right of way over those parcels of land described in the Second Schedule herein and the air space above the same to a height of not more than 150 ft above sea level and for that purpose the following liberties and licences, that is to say:

plant erections and works whether permanent or temporary thereon and to view the state and condition thereof or any part or parts thereof and to maintain, renew, conserve, and/or repair the said structures or any part thereof subject to the following conditions:

(a) That the owner of the said pieces of land, its successors, and assigns will not at any time make any erections thereon without the previous consent in writing of the Auckland Harbour Bridge Authority provided always that such consent shall not be unnecessarily or unreasonably withheld;

(b) That the owner of the said pieces of land, its successors, and assigns, will refrain from doing anything thereon that might in the opinion of the Auckland Harbour Bridge Authority tend to endanger the foundations of the said structures or their supports; and

(c) That the Auckland Harbour Bridge Authority, its successors, and assigns will restore the surface of the said pieces of land with the exception of the bases of any piers erected thereon to the condition in which the said piece of land was before the commencement of the said work, and shall keep the same in good and clean condition.

SECOND SCHEDULE

NORTH AUCKLAND LAND DISTRICT
(Land Over which Right of Way Easement is Taken)
All those pieces of land situated in Block XII, Waitemata Survey District, Borough of Northcote, North Auckland R.D., described as follows:
