licensees, and invitees, in common with any other person
lawfully entitled so to do from time to time and at all times
by day and by night to go, pass, and repass, with or without
animals, vehicles, implements, equipment, and machinery
of any kind over the said land described in the said Second
Schedule, and that a pipeline easement is hereby taken for
waterworks over the land described in the Third Schedule
hereto vesting in the Corporation as from the date hereinafter
mentioned the full, free, uninterrupted, and unrestricted right,
liberty, and privilege for the Corporation, and its successors,
and other, the owner, or owners occupier, or occupiers of the
said land mentioned in the first Schedule by means of under-
ground pipes laid or to be laid in the said land described in
the said Third Schedule to convey water under and through
the said land described in the said Third Schedule and to con-
struct and lay such underground pipe or pipes as shall be
necessary for the purpose aforesaid and from time to time to
inspect, maintain, alter, repair, replace, and relay such pipes
and also to make such entries with or without vehicles, appa-
ratus, equipment, implements, machinery, and tools of
whatsoever nature necessary for the purpose and to do all
such further acts and things as may be necessary for the
purpose of exercising and enjoying all or any of the rights,
privileges, and easements hereinbefore expressed provided
however that in constructing and laying the said pipes and in
opening up the soil and inspecting, maintaining, altering,
repairing, replacing, and relaying the said pipes as little
disturbance as possible will be caused to the surface of the
said land described in the said Third Schedule and the same
will be restored as nearly as possible to its former condition
and state and further declares that this Declaration shall have
effect from and after the 21st day of December 1970.

ALL that piece of land containing 29.74 perches situated in
Block IX, North Harbour and Blueskin Survey District, Otago
R.D., being part Section 46 (D.P. 462), coloured yellow on
plan.

Easement of Right of Way Taken

ALL that piece of land containing 1 rood 18.73 perches situated
in Block IX, North Harbour and Blueskin Survey District,
Otago R.D., being part Section 46, (D.P. 462), coloured sepia
on plan.

THIRD SCHEDULE
OTAGO LAND DISTRICT
Easement for Pipeline

ALL that piece of land situated in Block IX, North Harbour
and Blueskin Survey District, Otago R.D., being parts Section
46, shown coloured blue and sepia on plan and marked
“Pipeline Easement 6 feet either side of centre line as pegged”
and “Right of Way”.

As the same are more particularly delineated on the plan
marked M.O.W. 24718 (S.O. 17025) deposited in the office of
the Minister of Works at Wellington, and thereon coloured
as above-mentioned.
