The North Canterbury Catchment District Order 1970 Revoked and Further North Canterbury Catchment District Order Made

At the Government Buildings at Wellington this 27th day of October 1970

Present:

THE RIGHT HON. SIR KEITH HOLYOAKE, G.C.M.G., C.H., PRESIDING IN COUNCIL

PURSUANT to the Water and Soil Conservation Act 1967 and the Local Government Commission Act 1967, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby revokes the Order in Council made on the 2nd day of June 1970, and published in Gazette, on the 11th day of June 1970 at page 1013; and makes a further North Canterbury Catchment District Order as follows:


ORDER

  1. Title—This order may be cited as the North Canterbury Catchment District Order 1970.

  2. Extension of North Canterbury Catchment District—The areas described in the First Schedule hereto shall be included in the North Canterbury Catchment District.

  3. Constitution of Board—The Board of the said catchment district shall consist of 10 elective members, with representation as follows:

Christchurch City, Riccarton and Lyttelton Boroughs—3 members
Waimairi County—1 member
Paparua, Heathcote, and Mount Herbert Counties—1 member
Rangiora and Kaiapoi Boroughs and Rangiora and Eyre Counties—1 member
Malvern and Ashburton Counties—1 member
Oxford, Ashley, and Waipara Counties—1 member
Amuri and Cheviot Counties—1 member
Ellesmere, Wairewa, and Akaroa Counties—1 member.

  1. Interim constitution of Board—Notwithstanding the provisions of clause 3 of this order, until the members of the Board of the said catchment district are elected at the first triennial election of members after the alteration of the said boundaries, the Board of the said catchment district shall consist of 11 members, as follows:

The 10 members of the said Board as constituted before the said alteration of boundaries, together with 1 member to be nominated from amongst the councillors of the Counties of Amuri, Cheviot, and Waipara by a majority of the Councils of the said counties:

Provided that the Lyttelton Borough Council shall nominate 1 of the 4 members representing Christchurch City and Riccarton Borough to represent also Lyttelton Borough.

  1. Special provisions affecting part of catchment district—In respect of that part of the North Canterbury Catchment District that comprises the area described in the Second Schedule hereto, the following provisions shall apply:

(a) The provisions of Part V of the Soil Conservation and Rivers Control Act 1941 shall not apply:

Provided that they shall apply to the extent of any agreement to operate the whole or any part of the said Part V made, with the approval of the National Water and Soil Conservation Authority, between the North Canterbury Catchment Board and any territorial local authority having jurisdiction in the said area in respect of the whole or any part of the district of that local authority;

(b) The provisions of section 126 of the Soil Conservation and Rivers Control Act 1941 shall not apply:

Provided that they shall apply to the extent of any agreement to operate the provisions of that section made with the approval of the National Water and Soil Conservation Authority between the North Canterbury Catchment Board and any territorial local authority having jurisdiction in the said area in respect of the whole or any part of the district of that local authority;

(c) The provisions of subsection (1) of section 20 of the Water and Soil Conservation Act 1967 shall be restricted to conform with the provisions of paragraphs (a) to (d) of this clause;

(d) Each territorial local authority having jurisdiction in the said area shall make by way of an annual contribution to the North Canterbury Catchment Board towards the administration costs incurred by the said North Canterbury Catchment Board in carrying out its functions under the Water and Soil Conservation Act 1967 such sum or rate as may from time to time be fixed by any Act or regulation in that behalf.

Unless and until any such sum or rate has been so fixed the amount to be so paid shall be such sum as may be agreed upon between the territorial local authority and the North Canterbury Catchment Board; and, in the event of the failure of the territorial local authority and the North Canterbury Catchment Board to agree on any such sum, then such sum as may be determined by the National Water and Soil Conservation Authority. In addition, the North Canterbury Catchment Board may levy any of the said territorial local authorities having jurisdiction over the said area for the cost of any work undertaken or proposed to be undertaken in the district of that local authority for the purposes of the Water and Soil Conservation Act 1967 as hereinbefore restricted; and the cost of the work may be increased by a percentage to provide for administration and other expenses in respect of the work as more particularly described in subsection (2) of section 84 of the Soil Conservation and Rivers Control Act 1941, which for this purpose shall be read as if the references in that subsection to that Act were references to the Water and Soil Conservation Act 1967, such percentage being from time to time determined by agreement between the said Catchment Board and the said local authority:

Provided that, where an agreement as referred to in the foregoing paragraphs (a) and (b) of this clause is entered into with any territorial local authority, the provisions of this paragraph shall cease to operate or shall be modified in respect of the district of that territorial local authority to ensure compliance with the terms of the agreement.


FIRST SCHEDULE

AREAS TO BE INCLUDED IN THE NORTH CANTERBURY CATCHMENT DISTRICT

Firstly, all that area in the Canterbury Land District, Counties of Amuri, Cheviot, Waipara, and Ashley containing 2,770 square miles, more or less, bounded by a line commencing at a point on the mean high-water mark of the sea, in line with the south-western boundary of Reserve 4345, Block VIII, Teviotdale Survey District, and proceeding north-westerly to and along that boundary and its production to the middle of the public road forming the north-western boundary of Reserve 4345; thence north-easterly along the middle of that road to the middle of Webbs Road; thence north-westerly generally along the middle of that road to a point in line with the north-eastern boundary of Rural Section 11470; thence north-westerly to and along that boundary and the north-eastern boundaries of Rural Sections 11473 and 11471 to the northernmost corner of the last-mentioned section; thence north-westerly along a right line to Trig. Station (G) Seadown in Block V, Teviotdale Survey District; thence northerly along a right line to the intersection of the road sides forming the western and southern boundaries of Rural Section 10498; thence northerly generally along the western boundaries of Rural Sections 10498, 10496, and 6769 to the northernmost corner of the last-mentioned section; thence easterly and northerly along the southern and eastern boundaries of Rural Section 5820 to Stockgrove Road and along a right line to the south-eastern corner of Rural Section 10377; thence north-westerly along the north-eastern boundaries of Rural Sections 10377 and 27689 and Reserve 1929 and the production of the last-mentioned boundary to the middle of the main north road (Awanui-Bluff No. 1 State Highway); thence northerly along the middle of that road to a point in line with the middle of Georges Road; thence westerly to and along the middle of that road and the middle of the Amberley - Mount Brown Road to a point in line with the western boundary of
