Declaring Land and Easements Over Land Taken for the Purposes of an Aerodrome in Block II, Otokia Survey District

PURSUANT to section 32 of the Public Works Act 1928, the Minister of Works hereby declares that, a sufficient agreement to that effect having been entered into, the land described in the First Schedule hereto is hereby taken for the purposes of an aerodrome as from the date hereinafter mentioned; and that an easement of righ of way appurtenant to the land described in the said First Schedule hereto, over the land described in the Second Schedule hereto is hereby taken for the purposes of an aerodrome, vesting in Her Majesty the Queen as from the date hereinafter mentioned, the full and free right, liberty, licence, and authority in perpetuity for herself, her tenants, agents, servants, and workmen, in common with the registered proprietors of the said land, their successors in title, tenants, agents, servants, workmen, and all other persons lawfully using the land from time to time and at all times by day and by night, to go, pass and repass, with or without horses and domestic animals of any kind, and with or without carriages, vehicles, motor vehicles (loaded or unloaded), machinery and implements of any kind, and to maintain, repair, and keep open the said right of way; and that, an easement for the transmission of electric power appurtenant to the land described in the First Schedule hereto over the land described in the Third Schedule hereto, is hereby taken for the purposes of an aerodrome, vesting in Her Majesty the Queen as from the date hereinafter mentioned the full, free, uninterrupted, and unrestricted right, liberty, licence, and authority in perpetuity at all times, to transmit electric power by wires and cables, either by poles or underground, over, along, or beneath the surface of the land described in the said Third Schedule hereto and, for that purpose, to enter at all times and from time to time to erect such poles as are deemed necessary, or to lay, construct, place, reconstruct, inspect, repair, renew, and maintain such line or lines of wires or cables over, along, or beneath the surface of the land described in the said Third Schedule hereto; and also declares that this declaration shall take effect from and after the 28th day of September 1970.
