PURSUANT to the Local Government Commission Act 1967, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.

1. The area described in the Schedule hereto is hereby excluded from the County of Hawke’s Bay and included in the City of Hastings.

2. The alteration of the boundaries of the said county and the said city hereinbefore made shall be deemed to have been effected under the Municipal Corporations Act 1954.

ALL that area in the Hawke’s Bay Land District, County of Hawke’s Bay, being part Lot 23, D.P. 3699, containing 12.1 perches, more or less; shown, coloured blue, edged blue, on S.O. Plan 5845.

Boundaries of Inner Area of Auckland Metropolitan Drainage District Altered

PURSUANT to the Auckland Metropolitan Drainage Act 1960, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.

O R D E R

1. This order shall come into force on the 1st day of April 1970.

2. The boundaries of the inner area of the Auckland Metropolitan Drainage District are hereby altered so as to include in the inner area the areas described in the Schedule hereto.

SCHEDULE

ALL that area in the North Auckland Land District, Waitemata County, bounded by a line commencing at the southernmost corner of Lot 5, D.P. 19869, in Block XIII, Waitemata Survey District, and proceeding northerly generally down the middle of the stream forming part of the western boundary of Lot 1, D.P. 31394, to and north-easterly and south-easterly generally down the middle of the Swanson Stream to its intersection with the north-western boundary of Lot 1, D.P. 42849, and north-easterly along that boundary and easterly along the northern boundary of that Lot 1 and Lot 6, D.P. 42849, and south-easterly along the north-eastern boundary of Lot 6, afore-mentioned, to the north-western corner of Lot 12, D.P. 40763; thence southerly, westerly, and northerly generally along the boundary of the inner area of the Auckland Metropolitan Drainage District, as described in the Third Schedule to the Auckland Metropolitan Drainage Act 1960, to and south-easterly along the south-western boundary of Lot 5, D.P. 19869, to the point of commencement.

Also, all that area in the North Auckland Land District, Waitemata County, in Block VII, Titirangi Survey District, containing 1 rood and 16.2 perches, more or less, being Lot 60, D.P. 36329.

Also, all that area in the North Auckland Land District, Waitemata County, bounded by a line commencing at the westernmost corner of Lot 1, D.P. 59173, in Block II, Titirangi Survey District, and proceeding north-easterly along the north-western boundaries of that lot, Lot 2, D.P. 59173, and Lot 1, D.P. 40173, to and south-easterly and south-westerly generally along the generally western boundary of the inner area of the Auckland Metropolitan Drainage District, as described in the Third Schedule to the Auckland Metropolitan Drainage Act 1960, to and north-westerly along the south-western boundaries of Lot 13, Deeds Plan 717, and Lot 1, D.P. 59173, to the point of commencement.

Also, all that area in the North Auckland Land District, Waitemata County, Block VI, Titirangi Survey District, bounded by a line commencing at the northernmost corner of Lot 1, D.P. 7428, and proceeding easterly along the northern boundary of Allotment 27, Waikomiti Parish, to and south-westerly along the middle of Phillip Avenue to and northerly along the eastern boundary of the afore-mentioned Lot 1 to the point of commencement.

Also, all that area in the North Auckland Land District, Waitemata County, bounded by a line commencing in the middle of Phillip Avenue in Block VI, Titirangi Survey District, being on the boundary of the inner area of the Auckland Metropolitan Drainage District, as described in the Third Schedule to the Auckland Metropolitan Drainage Act 1960, in line with the southern boundary of Lot 24, D.P. 43701, and proceeding westerly to and along the said southern boundary to the southernmost corner of that lot; thence northerly generally along the western boundaries of Lots 24, 23, 22, 21, 20, 19, 18, 17, and 16 to and along a right line between the north-western corner of Lot 16 and the south-western corner of Lot 15 to and along the generally western boundaries of Lots 15, 14, 13, 12, 11, 10, 9, 8, 7, 6, 5, 4, 2, and 1, all the aforesaid lots being of D.P. 43701, to and easterly along the northern boundary of that Lot 1 and that boundary produced to and southerly generally along the middle of Glengarry Road and the middle of Phillip Avenue to the point of commencement.

Also, all that area in the North Auckland Land District, in Block XI, Otahuhu Survey District, containing 3 acres 2 roods 33.85 perches, more or less, being Lot 1, D.P. 59200, and that part of Lot 7, D.P. 8540, comprised in certificate of title, Volume 15B, folio 1022.

Exempting Land in the Westland Land District from the Operation of Part III of the Coal Mines Act 1925

PURSUANT to section 171 of the Coal Mines Act 1925, I, Sir Arthur Espie Porritt, Baronet, the Governor-General of New Zealand, do hereby exempt the land described in the Schedule hereto from the operation of Part III of the said Act.

WESTLAND LAND DISTRICT—GREY COUNTY

Lot 197, D.P. 86, being part Section 3, Block II, Mawheranui Survey District: area, 32 perches, more or less. Part certificate of title, Volume 2C, folio 91: save and excepting for Her Majesty the Queen all seams or beds of coal and all other minerals and metals, and reserving to Her Majesty the Queen and all persons lawfully entitled to work the said coal, minerals, and metals a right of ingress, egress, and regress under the said land.

As witness the hand of His Excellency the Governor-General this 14th day of January 1970.
