Declaring an Easement for the Laying of an Underground Telephone Cable Taken for Post Office Purposes in the City of Lower Hutt

PURSUANT to section 32 of the Public Works Act 1928, the Minister of Works hereby declares that, a sufficient agreement to that effect having been entered into, an easement for the laying of an underground telephone cable is hereby taken for post office purposes over the land described in the Schedule hereto from and after the 25th day of May 1970, vesting in Her Majesty the Queen the full and free right, liberty, and licence in perpetuity to lay, construct, place, reconstruct, inspect, repair, renew, and maintain an underground telephone cable or cables under, in, on, over, along, or across the said land, at such depth as shall be necessary, together with the full and free right, liberty, and licence for Her Majesty's servants, surveyors, workmen, agents, employees, and licensees, from time to time and at all times hereafter, either by night or by day, with or without implements, tools, vehicles, plant and machinery, materials, and other things, to enter upon the said land and to erect machinery and other erections thereon for the purpose of laying the said cables, and to break up the surface of the said land and sink the said cable, make excavations, construct and refill trenches and shafts on the said land, and to open up the surface of the said land and remove and replace the said cable as often as occasion shall require for the purpose of inspecting, amending, renewing, or repairing the said cable and maintaining the same in good and satisfactory repair, order, and condition.

ALL that piece of land containing 4.4 perches, situate in the City of Lower Hutt, being part Section 823, Hutt District, and being that part of Lot 1 coloured blue on Deposited Plan No. 30196; part certificate of title No. 5D/625, Wellington Land Registry.
