banks of a tidal water as are covered and uncovered
by the flow and ebb of the tide at ordinary spring
tides:
“Minister” means the Minister of Marine, and in-
cludes any officer, person, or authority acting by or
under the direction or authority of the Minister.
3. There is hereby granted to the Board, for a period of 21
years from the commencement of this order, subject to sections
8A and 165 of the Act and to the conditions specified in this
order—
(a) The control of the foreshore described in the First
Schedule to this order; and
(b) The control of the waters specified in the Second
Schedule to this order.
FIRST SCHEDULE
THAT portion of the foreshore in Hawke Bay in the Hawke’s
Bay Land District, Hawke’s Bay County, commencing at the
junction of the right bank of the Maraetotara River with
the mean high-water mark, ordinary spring tides, in Block V,
Clive Survey District, and proceeding in a generally south-
easterly direction to the north-easternmost corner of Lot 2,
D.P. 6509, in Block II, Kidnapper Survey District; as the
same is coloured red on plan marked M.D. 13784, and de-
posited in the office of the Marine Department at Welling-
ton.
SECOND SCHEDULE
ALL that area of water fronting the foreshore described in
the First Schedule to this order to a distance of 200 yd
measured from the edge of the water.
THIRD SCHEDULE
CONDITIONS
- Her Majesty or the Governor-General and all officers
in the Government service acting in the execution of their
duty, shall, at all times, have free ingress, passage, and egress
into, over, and out of the foreshore and waters described in
the First and Second Schedules to this order without pay-
ment. - Nothing in this order shall authorise the Board to do
or cause to be done anything repugnant to or inconsistent
with any law relating to the Customs or any provision of
the Harbours Act 1950 that is or may hereafter be in force. - The rights, powers, and privileges conferred by this
Order in Council shall not apply to those portions of the
foreshore required for securing the shore ends of any tele-
graph cables that are at the commencement of this order or
may be at any time subsequently laid down within that fore-
shore. - The Board may enclose any part or parts of the fore-
shore described in the First Schedule to this order for the
purpose of holding sports meetings or games, and may, by
bylaws, fix a charge for admission to such enclosed part or
parts:
Provided that the total number of days on which any par-
ticular part of that foreshore is so enclosed shall not exceed
six in any one calendar year. - Nothing in this order shall authorise the Board to re-
move or cause to be removed from the foreshore described
in the First Schedule to this order any stone, sand, shingle,
or shells without the consent in writing of the Minister being
first obtained. - Suitably worded signs shall be erected at main public
access ways to the foreshore described in the First Schedule
to this order, indicating that the control of the foreshore and
waters has been granted to the Board and that bylaws are
effective. - Subject to the provisions of section 8A of the Act, the
Board for and within the area of water described in the
Second Schedule to this order—
(a) May, by bylaw, do anything which a harbour board
may do by bylaw under section 232 of the Act.
(b) May appoint a harbourmaster and/or other officers
and define or limit their powers or duties.
(3) Shall administer such regulations made pursuant to
the Act as are applicable. - The powers, functions, duties, and authorities conferred
on the Board by this order may be at any time resumed by
the Governor-General, without payment or any compen-
sation whatever, on giving to the Board at least 6 calendar
months’ notice in writing. Any such notice shall be sufficient
if given by the Minister and delivered at or posted to the
Board at its public office.

Appointing the Deputy Transport Licensing Appeal Authority
and the Deputy Transport Charges Appeal Authority under
the Transport Act 1962
ARTHUR PORRITT, Governor-General
PURSUANT to section 158 of the Transport Act 1962, His Ex-
cellency the Governor General hereby appoints
Leslie Norman Ritchie, of Taupo
to be the Deputy Transport Licensing Appeal Authority and
Deputy Transport Charges Appeal Authority until the 30th
day of June 1970.
As witness the hand of His Excellency the Governor-General
this 27th day of April 1970.

ARTHUR PORRITT, Governor-General
PURSUANT to the authority conferred upon me by section 23A
of the Judicature Act 1908, as inserted by section 2 (1) of the
Judicature Amendment Act 1952, I, Sir Arthur Espie Porritt,
Baronet, the Governor-General of New Zealand, hereby de-
clare that the office of the Supreme Court at Westport, in the
Westland Judicial District, is abolished on and from the 1st
day of May 1970.
As witness the hand of His Excellency the Governor-General

appointed Chief of the General Staff, Army Headquarters,
and Senior Military Member of the Army Board, vice Major-

Major-General, and is transferred to the Generals’ List.
