  1. Nothing herein contained shall authorise the Council to remove, or cause to be removed, any stone, sand, shingle, or shells without the consent of the Minister being first obtained.

  2. Subject to the provisions of section 8A of the Act, the Council for and within the area of waters described in the First Schedule to this order—

(a) May, by bylaw, do anything which a harbour board may do by bylaw under section 232 of the Act;

(b) May appoint harbourmasters and/or officers, and define or limit their powers or duties.

  1. The said rights, powers, and privileges may be at any time resumed by the Governor-General, without payment of any compensation whatever, on giving to the Council 6 calendar months’ notice in writing. Any such notice shall be sufficient if given by the Minister and delivered at, or posted to, the last-known address of the Council in New Zealand.

Exempting Land in the Westland Land District from the Operation of Part III of the Coal Mines Act 1925

ARTHUR PORRITT, Governor-General

PURSUANT to section 171 of the Coal Mines Act 1925, I, Sir Arthur Espie Porritt, Baronet, the Governor-General of New Zealand, do hereby exempt the land described in the Schedule hereto from the operation of Part III of the said Act.

SCHEDULE

WESTLAND LAND DISTRICT—GREY COUNTY

Lot 153, D.P. 84, being part Section 3, Block II, Mawheranui Survey District: area, 1 rood, more or less. Part certificate of title, Volume 2c, folio 101; save and excepting for Her Majesty the Queen all seams or beds of coal and all other minerals and metals, and reserving to Her Majesty the Queen and all persons lawfully entitled to work the said coal, minerals, and metals a right of ingress, egress, and regress under the said land.

As witness the hand of His Excellency the Governor-General this 10th day of February 1970.

Appointing a Deputy to a Member of the Water Allocation Council

PURSUANT to section 10 of the Water and Soil Conservation Act 1967, I, Sir Arthur Espie Porritt, Baronet, the Governor-General of New Zealand, do hereby appoint James Raymond McGimpsey, of Christchurch, production manager, as deputy to Bartholomew Robin Mann, of Christchurch, a member of the Water Allocation Council, in place of Alan Harding Swaney, resigned.

PURSUANT to section 15 of the Royal New Zealand Air Force Act 1950, His Excellency the Governor-General has been pleased to approve the following appointments, extensions of commissions, extension of commission and age for retirement, transfer, resignation, and retirements of officers of the Royal New Zealand Air Force.

REGULAR AIR FORCE

GENERAL DUTIES BRANCH

Appointments

Group Captain Cyril Laurence Siegert, M.V.O., D.F.C., A.F.C., p.c.s., a.w.s. (70105), to be Temporary Air Commodore for the period from 15 September 1969 until 8 January 1970.

Flight Lieutenant John Murray Denton (80031) is appointed to a career commission in the General Duties Branch Regular Air Force, for a period to expire on 15 December 1980, with effect from 13 January 1970.

Flight Lieutenant Graham Robert Lloyd (80620) is appointed to a career commission in the General Duties Branch, Regular Air Force, for a period to expire on 21 June 1982, with effect from 7 January 1970.

TECHNICAL BRANCH

Appointment

Engineer Division

Flight Lieutenant Alan George Parslow Dick (75191) is appointed to a permanent commission in the Technical Branch (Engineer Division), Regular Air Force, with effect from 10 December 1969.

TERRITORIAL AIR FORCE

Extension of Commission

Flight Lieutenant Peter Edward Hills (134224) is granted an extension of his commission, for a period to expire on 8 February 1975.

Retirement

Flight Lieutenant Alfred William Burge, D.F.C. (133837), is retired, with effect from 12 January 1970.

RESERVE OF AIR FORCE OFFICERS

Transfer

Flight Lieutenant William Victor Tangney (71675) is transferred from the Administrative and Supply Branch (Equipment Division), Regular Air Force, to the Reserve of Air Force Officers, for a period to expire on 31 December 1973, with effect from 3 January 1970.

Squadron Leader Ronald Henry Swain is granted a further extension of his commission and age for retirement, for a period to expire on 13 January 1971.

Resignation

Pilot Officer Phillip Wayne Ngeru is permitted to resign his commission, with effect from 31 December 1969.
