Land and an Easement over Land Taken for Electricity Supply Purposes in the City of Wellington

ARTHUR PORRITT, Governor-General

A PROCLAMATION

Pursuant to the Public Works Act 1928 and section 35 of the Finance Act (No. 2) 1945, I, Sir Arthur Espie Porritt, Baronet, the Governor-General of New Zealand, hereby proclaim and declare that the land described in the First Schedule hereto is hereby taken for electricity supply purposes and shall vest in the Mayor, Councillors, and Citizens of the City of Wellington from and after the date hereinafter mentioned, together with the following rights, liberties, and privileges in perpetuity over the parcels of land described in the Second Schedule hereto, to the intent that the easement herein created shall be forever appurtenant to the land described in the First Schedule hereto:

(a) The right to transmit electrical energy backwards and forwards under and along the said parcels of land.

(b) The right of ingress, egress, and regress on foot, with or without vehicles of all descriptions, either loaded or unloaded, by night as well as by day, over and along the said parcels of land.

(c) The right to enter upon the said parcels of land at all reasonable times by its servants, agents, and workmen, with all necessary tools, implements, plant, machinery, and vehicles for the purpose of laying, constructing, repairing, renewing, and maintaining, at such depths as shall be necessary, all cables and fittings as shall be required for the unimpeded transmission of electrical energy, as aforesaid.

(d) The right to dig up and break the surface of the said parcels of land or any parts thereof and, generally, to do and perform all acts and things as may be necessary or proper, including reinstatement of the said lands for any of the purposes herein mentioned.

And I also declare that this Proclamation shall take effect on and after the 29th day of September 1969.

All those pieces of land situated in Block VII, Port Nicholson Survey District, City of Wellington, Wellington R.D., described as follows:

A PROCLAMATION

Pursuant to section 421 of the Maori Affairs Act 1953, I, Sir Arthur Espie Porritt, Baronet, the Governor-General of New Zealand, hereby declare the land described in the Schedule hereto and comprised in a roadway, laid out by the Maori Land Court by orders made on the 18th day of February 1933 and the 21st day of March 1967, to be road.

Pursuant to the Public Works Act 1928 and section 35 of the Finance Act (No. 2) 1945, I, Sir Arthur Espie Porritt, Baronet, the Governor-General of New Zealand, hereby proclaim and declare that a right of way easement in gross is hereby taken for harbour works over the land described in the Schedule hereto, vesting in the Mayor, Councillors, and Citizens of the Borough of Kaiapoi the full and free right, liberty, licence, and authority in perpetuity to construct and use the right of way, with the right for the invitees, servants, agents, and workmen of the Mayor, Councillors, and Citizens of the Borough of Kaiapoi, from time to time and at all times hereafter, to go, pass, and repass, with or without horses or other animals or vehicles, over the land described in the said Schedule and to maintain, repair, and keep open the said right of way.
