Land and a Drainage Easement over Land Taken for Soil Conservation and River Control Purposes in Blocks VII and III, Te Mata Survey District, and Previous Declaration Revoked

———

PURSUANT to the Public Works Act 1928, the Minister of Works hereby revokes the Declaration, dated the 28th day of August 1968 and published in Gazette, 10 October 1968, Volume III, page 1757, taking land and a drainage easement over land for soil conservation and river control purposes in Blocks VII and III, Te Mata Survey District, and hereby declares that, sufficient agreements to that effect having been entered into, the land described in the First Schedule hereto is hereby taken for soil conservation and river control purposes and shall vest in the Hawke’s Bay Catchment Board from and after the date hereinafter mentioned and also hereby declares that a drainage easement over the land described in the Second Schedule hereto is hereby taken from and after the date hereinafter mentioned, vesting in the Hawke’s Bay Catchment Board full and free right, liberty, licence, and authority in perpetuity for the said board, its servants, agents, workmen, licensees, and invitees (in common with all other persons lawfully using the same), from time to time, and at all times by day and by night to go, pass, and repass, with or without horses and domestic animals of any kind, and with or without carriages, vehicles, machinery, motor vehicles, and implements of any kind, over and along the land described in the said Second Schedule, and to maintain, repair, and keep open the said drain; and also declares that the aforesaid easement shall be held appurtenant to the land described in the First Schedule hereto from and after the 28th day of April 1969.
