CONTRACT OF BUILDING CADETSHIP
This Deed, made the ……………… day of ……………… 19………, between ……………… [Full name of Employer] of ……………… [Address and occupation] hereinafter called “the employer”, of the first part, and ……………… [Full name of Building Cadet’s parent or guardian] of ……………… [Address] hereinafter called “the guardian”, of the second part, and ……………… [Full name of building cadet] of ……………… [Address] a minor born on the ……………… day of ……………… 19………, hereinafter called “the building cadet”, of the third part: Witnesseth as follows:

The employer hereby covenants with the building cadet: and the employer, as a separate covenant with the guardian, also covenants with the guardian that the employer take the building cadet into his employment as a building cadet in the building, construction and civil engineering industry and the building cadet and the guardian hereby jointly and severally covenant with the employer that the building cadet will serve the employer as a building cadet for the term and upon and subject to the condition set forth in the Determination of the Building Technician Training Council established as provided for in section 3 of the Technician Training Act 1967.

The employer covenants to employ the building cadet as:
(a) A part-time student
(b) A full-time student

The term of the building cadetship hereby created shall be 5 years commencing on the ……………… day of ……………… 19………, and shall be served at such place or places as may from time to time be mutually agreed upon by the parties hereto as expedient and necessary to the proper performance of the contract.

The building cadet covenants that he shall diligently and faithfully obey and serve the employer as his building cadet for the hereinbefore prescribed term and that he will not commit or permit or be accessory to any hurt or damage to the employer or his property but will do everything in his power to prevent any such hurt or damage occurring.

The employer covenants during the prescribed term of the building cadetship to the best of his power, knowledge, and skill to train and instruct the building cadet or cause him to be so trained and instructed to the extent that at the expiration of the said time he will have been given the opportunity to become competent in all such branches of the building industry as are required in the fulfilment of the course of study laid down by the Technicians Certification Authority of New Zealand for the New Zealand Certificate in Building.
Without limiting the generality of this contract the employer further covenants that the employer will train the building cadet in each and all the operation and skills set out and described in the Schedule—Training Scheme for Building Cadets.

The building cadet covenants further that he will enrol for and diligently carry on with such courses of study as will enable him, during the term of his contract, to sit for the examinations in the New Zealand Certificate in Building conducted by the Technician Certification Authority of New Zealand.

It is agreed between the parties that in the event of the building cadet finding the course of study for the New Zealand Certificate in Building beyond his capabilities, and subject to his obtaining a certificate to that effect from the principal of the technical institute concerned, it may be mutually agreed between the parties that this contract may be amended to permit the employer to train the building cadet in draughting (architectural) or quantity surveying to enable him, during the period of his contract, to change to the New Zealand Certificate in Draughting (Architectural) or the New Zealand Certificate in Quantity Surveying, and in such case this contract shall be endorsed accordingly.

It is further agreed that, as an alternative to the form of adjustment of this contract proposed in clause 7 of this contract, the building cadet shall be entitled to apply to the New Zealand Carpentry and Joinery Apprenticeship Committee for an apprenticeship with any employer with any credit in time approved by that committee.

The employer shall supply the building cadet with a copy of the Conditions of Employment for Building Cadets and or the Training Scheme for Building Cadets.

The building cadet covenants further that he will not divulge otherwise than in the discharge of his duties, to any person whomsoever any information, whether in the nature of trade secrets, financial information, or otherwise whatsoever, acquired by him in the course of his duties or in any other way in his capacity of building cadet.
