MOUNT HERBERT COUNTY COUNCIL

RESOLUTION MAKING SPECIAL RATE

The Mount Herbert County Council resolved that it, for the purpose of erecting a plant shed at Church Bay, within the County, raise a loan of $2,000 from the Canterbury Museum Trust Board for a term of 5 years, at 5½ percent, repayable by half-yearly instalments of $200 plus interest; such loan to be secured by a special rate of 0.00012c in the dollar on the capital value of all rateable property within the Mount Herbert County.

CHARITABLE TRUST ACT 1957

NOTICE OF APPLICATION

In the matter of the Charitable Trusts Act 1957: The Saint Matthews Collegiate School or Schools Trust Board hereby gives notice that it has filed, in the Supreme Court at Masterton, a notice of motion for an order approving a scheme varying the mode of administering the trusts set out in the deed of trust dated the 20th day of January 1921, a true copy of which deed is filed with the said notice of motion. The motion has been set down for hearing at Wellington on the 19th day of February 1969. The provisions of the scheme are:

  1. Clause 2 of the said deed:

The words “St. Matthews Collegiate School” or “Schools” shall be deleted in the first and second lines thereof, and the words “Saint Matthews Schools” shall be inserted in their place. There shall be appended to the said clause the words: “The trustees shall have power from time to time to designate particular names to particular schools”.

  1. Clause 8 of the said deed:

a. Delete subclause (b) as under:

The said Robert Oliver Smith, Archer Hosking, Harry Floyd Coom, Charles Joseph Bennett, and Harper Phillip Hugo have been appointed trustees by the holders of debentures issued in connection with the said school. Two of them (to be determined by lot at a meeting of the trustees) shall retire from office on the 1st day of December 1922 and two persons shall be appointed in their places (the retiring trustees being eligible for reappointment). The other three shall retire on the 1st day of December 1924 and three persons shall be appointed in their places (the retiring trustees being eligible for reappointment). Every trustee hereafter appointed or reappointed in pursuance of the foregoing provisions of this subclause shall hold office for six (6) years from the date of his appointment and shall be eligible for reappointment. Every appointment of trustees in pursuance of this subclause shall be made by and at a meeting of the persons to whom debentures have been or shall hereafter be issued in connection with the said school (but not by persons who have acquired or may acquire such debentures by delivery, transfer, or transmission from the original holders): every such meeting shall be summoned and conducted in such manner as the trustees shall from time to time direct: and in case of failure from any cause whatever to make an appointment in pursuance of the foregoing provisions of this subclause, the trustees may proceed to make such appointment.

Insert in its place new subclause (b) as under:

Harold Arthur Roland Dunderdale, Geoffrey Harold Blundell, John Harold Tremaine Maunsell, Joseph James Payton, and Edmund David Watts being at present trustees shall remain in office, but shall retire on the 31st day of December 1968 and upon such retirement a like number of trustees shall be appointed in their place. The retiring trustees shall be eligible for reappointment. In addition, not less than two nor more than five persons shall be appointed trustees from time to time so that the total number of trustees shall be not less than 12 nor more than 15. All such appointments of trustees under this subclause shall be made by all the existing trustees, including retiring trustees, if present, and all trustees so appointed shall hold office for a period of 6 years from the date of their appointment and shall be eligible for reappointment.

b. Add to subclause (c) (which provides for the vestry of the Saint Matthew Parish to appoint three trustees) the words:

“At the first ordinary meeting of the said vestry after the date of the approval of this scheme by the Court the said vestry shall appoint a fourth trustee who shall hold office for six (6) years from the date of his appointment, subject to the same conditions as the other trustees appointed pursuant to this subclause, so that the said vestry shall in future have the appointment of four trustees instead of three trustees as formerly”.

c. Delete subclause (f) as under:

No person (other than the said vicar for the time being and the said Harper Phillip Hugo) shall be capable of being appointed a trustee whose name is not at the time of his appointment registered upon the churchwarden’s books of some parish.

Insert in its place new subclause (f) as under:

No person, other than the said vicar for the time being, shall be capable of being appointed a trustee whose name is not at the time of his appointment registered on the churchwardens’ books of some parish: provided, however, that three trustees other than the said vicar need not be subject to such restriction.

  1. Clause 9 of the said deed (which provides that the assets of the Board may eventually be handed over to the Wellington Diocesan Trustees) shall be deleted.

All documents relating to the said scheme are available for perusal in the Masterton Registry of the Supreme Court.

Any person desiring to oppose the scheme must give written notice of his intention to do so to the Registrar of the Supreme Court at Masterton, to the Saint Matthews Collegiate School or Schools Trust Board, and to the Attorney General not less than seven clear days before the said date of hearing of the said motion.
