Any person wishing to lodge an objection to the granting of these applications should do so in writing on or before 7 March 1968.
Submissions should include a reference to the application number, Tariff item, and description of goods concerned, be addressed to the
Comptroller of Customs, Private Bag, Wellington, and supported by information as to:

(a) The range of equivalent goods manufactured locally;
(b) The proportion of New Zealand and imported materials used in manufacture;
(c) Present and potential output; and
(d) Details of factory cost in terms of materials, labour, overhead, etc.

Price Order No. 2072 (Nails)

Pursuant to the Control of Prices Act 1947, I, Clifford Ernest Beard, pursuant to a delegation from the Secretary of Industries and Commerce, acting under a delegation from the Price Tribunal, hereby make the following price order:

  1. This order may be cited as Price Order No. 2072, and shall come into force on the 16th day of February 1968.
  2. (1) Price Order No. 2060* is hereby revoked.
    (2) The revocation of the said order shall not affect the liability of any person for any offence in relation thereto committed before the coming into force of this order.

APPLICATION OF THIS ORDER

  1. This order applies with respect to nails of the kinds and gauges specified in the Schedule hereto.

FIXING MAXIMUM WHOLESALE AND RETAIL PRICES FOR NAILS TO WHICH THIS ORDER APPLIES

Wholesalers' Prices
  1. The maximum price that may be charged or received by any wholesaler for any nails to which this order applies shall be determined as follows:

(a) For nails sold by a wholesaler whose place of business is situate in any of the cities of Auckland, Wellington, Christchurch, Dunedin, plus Porirua for 5 to 16 gauge nails only, and Palmerston North for 7 to 16 gauge nails only, the maximum wholesale price shall be the appropriate price fixed in the Schedule hereto:

(b) For nails sold by any other wholesaler, the maximum wholesale price shall be the appropriate price fixed in the Schedule hereto increased by a proportionate part of any freight charges incurred by the wholesaler in obtaining delivery into his premises.

Retailers' Prices
  1. The maximum price that may be charged or received by any retailer for any nails to which this order applies shall be determined as follows:

(a) For nails sold by a retailer whose place of business is situate in any of the cities of Auckland, Wellington, Christchurch, Dunedin, plus Porirua for 5 to 16 gauge nails only, and Palmerston North for 7 to 16 gauge nails only, the maximum retail price shall be the appropriate price fixed in the Schedule hereto:

(b) For nails sold by any other retailer, the maximum retail price shall be the appropriate price fixed in the Schedule hereto increased by a proportionate part of any freight charges paid by the retailer to the wholesaler from whom the nails were purchased or incurred by the retailer in obtaining delivery into his premises.

  1. If in respect of any lot of nails sold by a retailer the maximum retail price calculated in accordance with the foregoing provisions of this order is not an exact number of cents, the maximum price of the lot shall be calculated to the nearest whole cent.

Special Prices Where Extraordinary Charges Incurred

  1. Notwithstanding anything in the foregoing provisions of this order and subject to such conditions, if any, as it thinks fit, the Tribunal, on application by any wholesaler or retailer, may authorise special maximum prices in respect of any nails to which this order applies where special circumstances exist, or for any reason extraordinary charges (freight or otherwise) are incurred by the wholesaler or retailer. Any authority given by the Tribunal under this clause may apply with respect to a specified lot or consignment of nails, or may relate generally to all nails to which this order applies sold by the wholesaler or retailer while the approval remains in force.

DUTY IMPOSED ON WHOLESALERS

  1. Every wholesaler who sells any nails to which this order applies shall specify in the relative invoice with respect to each lot of nails sold the quantity, the gauge, and the length of the nails.
