Vesting the Management of Certain Wharves in Akaroa Harbour in Akaroa County Council

At the Government House at Wellington this 23rd day of September 1968

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

  1. Pursuant to the Harbours Act 1950, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council (hereinafter called the Council, which term shall include its administrators, successors, or assigns, unless the context requires a different construction) hereby vests in Akaroa County Council the management of the wharves in Akaroa Harbour known as “Town Wharf” and “Dalys Wharf”, as shown on plans marked M.D. 1333, 1334, 1335, 1336, and 4017 and deposited in the office of the Marine Department at Wellington, such vesting to be subject to the terms and conditions set forth in the Schedule hereto.

  2. The Order in Council made on 31 January 1956* vesting the management of “Town Wharf” and “Dalys Wharf” in Akaroa Borough Council (abolished by Order in Council dated 20 February 1957†) and prescribing dues and rates, and amended on 17 December 1963‡, is hereby revoked.

SCHEDULE

CONDITIONS

  1. The vesting of the management of the wharves is subject to the Foreshore Licence Regulations 1960, with the exception of clause 12 (4) of the said regulations, which, for the purpose of this Order in Council, is hereby excluded, and the provisions of the said regulations shall, so far as applicable, apply hereto.

  2. The term of the vesting shall be 14 years from the 1st day of September 1968.

PURSUANT to the Valuation of Land Act 1951, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby directs that the District Valuation Rolls for the districts enumerated in the Schedule hereto shall be revised by the Valuer-General as at 1 October 1968.
