Taking Land for Public Purposes at Niue

ORDER IN COUNCIL

At the Government Buildings at Wellington this 16th day of September 1968

Present:

THE RIGHT HON. KEITH HOLYOAKE, C.H., PRESIDING IN COUNCIL

PURSUANT to section 326 of the Niue Act 1966, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby takes the land described in the Schedule hereto for the following public purposes, namely, education.

SCHEDULE

ALL that parcel of land containing 1 rood 23 perches, more or less, situated in the District of Alofi in Niue, being the whole of the land known as Section 35, Paliati, Block II, Alofi District, and being all the land comprised in an order of the Land Court made on the 19th day of September 1966, on investigation of title; as the same is more particularly delineated on the plan signed by the Resident Commissioner of Niue and deposited in the Office of the Registrar, Land Court, Niue, under number 49.

PURSUANT to the Trustee Savings Banks Act 1948, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.

ORDER

  1. Title—This order may be cited as the Canterbury Savings Bank Order 1962, Amendment No. 5, and shall be read together with and deemed part of the Canterbury Savings Bank Order 1962* (hereinafter referred to as the principal order).

  2. Bank premises—The principal order is hereby amended by inserting, after clause 9, the following new clause:

“9A. Notwithstanding anything in the proviso to section 28 of the Act, the Bank may, with the prior written consent of the Minister, incur expenditure under that section in excess of the limit imposed by that proviso.”

PURSUANT to the Navy Act 1954, His Excellency the Governor-General has approved the following appointments, promotions, and terminations of appointment in the Royal New Zealand Navy.

Surgeon Lieutenant Commander P. A. S. Edmonds, released (engagement completed), to date 26 September 1968, and placed on Emergency List, to date 27 September 1968.

Lieutenant Commander P. C. E. Oldham, released (reverted to RNZNVR: Short-service Commission completed), to date 17 September 1968.

Lieutenant D. T. S. Frankland, released (own request), to date 1 September 1968, and placed on Retired List, to date 2 September 1968.

Gerard John Power, entered in rank of Lieutenant (SP) under an 8-year Short-service Commission, to date 23 January 1968 (amends Gazette, No. 15, of 21 March 1968).

Temporary Lieutenant C. P. C. Calkin, promoted to rank of Lieutenant (SL) and reappointed, to date 16 August 1968.

Sub Lieutenant M. J. Murdoch, advanced to Assistant Surveyor Third Class, to date 1 July 1968.

Instructor Lieutenant P. Turpie, RN, entered in rank of Instructor Lieutenant under a 5-year Short-service Commission, to date 13 February 1968, with seniority of 5 March 1963 (amends Gazette, No. 15, of 21 March 1968).

John Stuart Melrose, entered in RNZN under a 5-year Short-service Commission, in the rank of Instructor Lieutenant, to date 10 July 1967 (amends Gazette, No. 49, of 10 August 1967).

Ensign D. A. Cootes, promoted to rank of Sub Lieutenant, and reappointed, to date 3 July 1968, with seniority of 3 July 1967.

Ensign L. R. Kelpe, released (appointment terminated), to date 6 September 1968.
