Declaring Land and Easements Over Land Taken for Waterworks Purposes in Block III, Waipu Survey District, Whangarei County

Pursuant to section 32 of the Public Works Act 1928, the Minister of Works hereby declares, a sufficient agreement to that effect having been entered into, that the land described in the First Schedule hereto is hereby taken for waterworks purposes and shall vest in the Chairman, Councillors, and Inhabitants of the County of Whangarei (hereinafter referred to as "the Corporation") from and after the date hereinafter mentioned, that an easement (right of way) is hereby taken for waterworks purposes over the land described in the Second Schedule vesting in the Corporation from and after the date hereinafter mentioned the full, free, and uninterrupted right, liberty, and licence for the Corporation its engineers, servants, agents, workmen, contractors, licensees, and invitees from time to time and all times by day and by night to go, pass, or repass with or without vehicles or other equipment over the land described in the said Second Schedule, and that a pipeline easement is hereby taken for waterworks purposes over the land described in the Third Schedule hereto vesting in the Corporation from and after the date hereinafter mentioned first the full, free, and uninterrupted right, liberty, and licence for the Corporation to drain filter-wash water along, under, or over the said land from the land described in the said First Schedule and for that purpose to lay and maintain a line or lines of water pipes through and under the piece of land described in the said Third Schedule and secondly in order to construct or maintain the efficiency of any such pipelines the full, free, and uninterrupted right, liberty, and licence for the Corporation, its engineers, servants, agents, workmen, contractors, licensees, and invitees to go, pass, or repass, with or without vehicles or other equipment of whatsoever nature necessary for the purpose of laying, inspecting, cleansing, repairing, maintaining, and renewing any such pipeline or any parts thereof, to the intent that such easements hereinbefore referred to shall be forever appurtenant to the land described in the said First Schedule; and further declares that this Declaration shall have effect from and after the 16th day of September 1968.
