Milk Pricing and Indecent Publications Decisions




This determination shall apply throughout New Zealand.

The foregoing provision of this determination shall be interpreted subject to the power of the Board from time to time to fix different maxima pursuant to the provisions of subsection (3) of section 32 of the Milk Act 1967.

For the purpose of this determination—
(a) Milk sold retail is that sold to commercial users or consumers in quantities of less than 2 gallons in each lot delivered.
(b) Milk sold wholesale is that sold to commercial users or consumers in quantities of 2 gallons and over in each lot delivered or sold to occupiers of shop dairies in any quantity.
(c) “Shop dairy” shall have the meaning ascribed to it in the Milk Price Notice 1968 (S.R. 1968/128).
Notice is also hereby given that the New Zealand Milk Board has also determined, pursuant to section 32 of the Milk Act 1967, that, as from and including the 1st day of September 1968, the maximum price which may be charged by any milk vendor (as that term is defined in section 2 of the Milk Act 1967) who operates but does not own a milk round (as that term is defined in section 2 of the Milk Act 1967) for goodwill on the sale of the business of such vendor shall not exceed in respect of the sale of such business a sum of $1.00.

This determination also shall apply throughout New Zealand.

Decision of Indecent Publications Tribunal

In the matter of the Indecent Publications Act 1963 and in the matter of an application to the Tribunal for a decision in respect of the book Satan’s Saint, by Guy Endore, published by Panther Books Ltd., London. Paperback edition, NZ65c.

DECISION OF THE TRIBUNAL

LEAVE to submit the book to the Tribunal was granted by the Minister of Justice. Mr Heron appeared at the hearing as Counsel for the publishers and made submissions.

This is a serious fictional biography of the Marquis de Sade. In matters of fact it seems to be an accurate record and it does give some insight into the development and character of a man about whom, for all his depravity, the public is entitled to know. There is no undue or sensational emphasis upon its inevitably disturbing aspects. These aspects are inseparable from the theme, but they are such as to make the book an undesirable one in the hands of juveniles. The Tribunal therefore decides that the book is indecent in the hands of persons under the age of 18 years.

DECISION OF THE TRIBUNAL

THIS book has been submitted to the Tribunal, by leave of the Minister of Justice, for classification. Submissions were made at the hearing by Mr Heron of Counsel for the publishers, Panther Books Ltd., London.

This is a novel in the realist tradition. The author states that the events and persons described are products of his imagination, but it is clear that descriptions of places and ways of living and the general interpretation of a kind of society owe a great deal to first-hand experience.

Although this book is violent and contains scenes which we think could be disturbing to immature minds, we do not think it gives a false presentation of a certain kind of continental life. We note that the author enjoys a measure of literary standing, and that Vol. 2 of this work has won the Amsterdam Literary Prize.

The book has literary merit but there are some passages which are undoubtedly “indecent” within the extended meaning of that word in section 2 of the Act. The Tribunal considers it necessary to restrict its circulation, and therefore decides it to be indecent in the hands of persons under 18 years of age.

IN the matter of the Indecent Publications Act 1963 and in the matter of an application for a decision in respect of the magazine Exposure and Design, No. 1 to 6, published by Elysium Inc., Los Angeles, California, U.S.A., US$2.00.

DECISION OF THE TRIBUNAL

THIS series was submitted by the Comptroller of Customs who did not appear and was not represented at the hearing. Submissions in writing were received on behalf of the publisher from its Attorney, Mr Stanley Fleishman, of Hollywood, California.

This quarterly, edited by Ed Lange, claims to be “dedicated to exploring the symmetry and beauty of the human nude”; the editorial further claims that this publication rejects artificially contrived poses and concealment of the pubic area; we cannot think these claims justified. There is much that is deliberately contrived, ugly, grotesque, and unnatural. In spite of some beautiful camera studies the whole is judged by us to fall into category three of our decision in the matter of a reference from the Magistrate’s Court at Auckland of some 16 nudist and photographic magazines, set out in the New Zealand Gazette, No. 46, 25 July 1968, pp. 1251–1254, at p. 1253.

We accordingly declare all the six issues of Exposure and Design which have been referred to us to be indecent.
