Indecent Publications Act 1963
In the matter of the Indecent Publications Act 1963 and in
the matter of an application to the Tribunal for a decision in
respect of the magazine Playboy, November 1967, Vol. 14,
No. 11.
DECISION OF THE TRIBUNAL
THE Comptroller of Customs has applied to the Tribunal for
a classification of the magazine Playboy, November issue,
1967. There were no submissions on behalf of the Comptroller.
Mr R. A. Heron appeared as Counsel for the publishers,
H.M.H. Publishing Coy., Inc., of Chicago, Illinois, and for
Gordon and Gotch (N.Z.) Ltd., the New Zealand distributors.
Mr Heron called Mr F. A. Smith, the General Manager of
Gordon and Gotch (N.Z.) Ltd., to testify as to the method
of distribution; he also submitted a letter from a reader of
the magazine.
In a decision dealing with earlier issues of this magazine,
the Tribunal made the following statement:
"Playboy is a sophisticated and ably written magazine,
designed primarily for men of affluence and intellect.... Its
literary and pictorial quality is acknowledged. The contents
include searching and informative interviews, short stories,
authoritative and stimulating articles on a wide variety of
topics by contributors who are in some cases world-famous,
along with pages of nude or almost nude models very capably
photographed, various drawings, jokes, and cartoons. There
is considerable emphasis on sex, but virtually no smut or
snigger."
The issue before us is generally in line in style and standard
with those earlier numbers, which we have already considered.
It does, however, contain the latest article in a critical and
historical series under the title "The History of Sex in
Cinema". This is the seventeenth article in the series, and
it is produced under the sub-title "The Stag Film". Without
the accompanying illustrations, the text of the article would
not come into question, but, the question remains whether
the whole article should be condemned because of them.
After due consideration, we have come to the conclusion that
they are acceptable as relevant illustrations to a serious study.
Divorced from a consideration of the text, as they might be
in the hands of juveniles, we think they are objectionable.
Our attention has been drawn to a report to the effect that
before the magazine was approved for circulation in some
other places the pages containing the illustrations in question
were removed. Our statute contains no provision for the
imposition of such a condition.
We classify this issue of the magazine as not indecent
except in the hands of persons under 17 years of age.

Waiheke Road District—Alteration of Boundaries
PURSUANT to section 36 of the Local Government Commission
Act 1961, it is hereby notified that the Local Government
Appeal Authority has fixed 10 a.m., on Wednesday, 14
February 1968, as the time, and the Board Room, Auckland
Regional Authority, 121 Hobson Street, Auckland, as the
place, for the hearing of the appeal by the Auckland Har-
bour Board against the final scheme of the Local Government
Commission, dated 27 April 1967, providing for the inclusion
in the Waiheke Road District of all land lying between the
present boundary of the Waiheke Road District and low-
water spring-tide mark.
