Ruato ki Development Scheme Amending Notice 1967, No. 8

WHEREAS, by virtue of the notices described in the First
Schedule hereto, the land described in the Second Schedule
hereto is now subject to Part XXIV of the Maori Affairs
Act 1953, and it is desired to vary the same:
Now, therefore, pursuant to section 332 of the Maori Affairs
Act 1953, the Board of Maori Affairs hereby gives notice as
follows:

NOTICE

  1. This notice may be cited as the Ruatoki Development
    Scheme Amending Notice 1967, No. 8.
  2. The notices referred to in the First Schedule hereto are
    hereby amended by omitting all reference to the land described
    in the Second Schedule hereto.
  3. The land described in the Second Schedule hereto is hereby
    released from Part XXIV of the Maori Affairs Act 1953.

The Road Classification (Waimairi County) Notice No. 2,
1967

PURSUANT to regulation 3 of the Heavy Motor Vehicle Regula-
tions 1955*, the Commissioner of Transport hereby gives the
following notice.

NOTICE

  1. This notice may be cited as the Road Classification
    (Waimairi County) Notice No. 2, 1967.
  2. The Waimairi County Council’s proposed classification of
    roads as set out in the Schedule hereto is hereby approved.
  3. The Warrant dated the 14th day of August 1967†, which
    relates to the classification of the roads as described in the
    Schedule hereto is hereby revoked.

The Indecent Publications Act 1963

IN the matter of the Indecent Publications Act 1963 and
in the matter of an application by Robert White, sales director,
on behalf of Panther Books Ltd., of London, regarding a
book The Psychopathia Sexualis, by R. V. Krafft-Ebbing,
submitted to the Tribunal with the leave of the Minister of
Justice.

DECISION OF THE TRIBUNAL
LEAVE to submit this book to the Tribunal was granted by
the Minister of Justice. We have considered it accordingly.

It is very different in character from books the Tribunal
has had hitherto to consider. It is a scientific treatise, largely
the case book of an eminent Viennese psychiatrist dealing
in particular with sexual aberrations. It was first published
in 1886, and this, the seventeenth edition, has been brought up
to date by the inclusion of fresh material. The particular book
we have to consider is a “paper back” priced at one dollar
25 cents.

The book is not suitable reading for adolescents but
because of its specialist value, and having regard to the
provisions of subsection (b) of section 11 of the Statute we
do not classify it as indecent. Mr Heron had appeared on
behalf of the publisher and argued that the book was
produced as a serious study of the topics it dealt with. The
Justice Department was represented and submitted that, because
of the special character of the book there should be some
restriction on sale.

Although we do not classify the book as indecent we make
an order restricting its sale to persons concerned either
professionally or as students, with sexual abnormalities.
