Notice of Intention to Take Land in the Borough of Kumara, for a Post Office and Automatic Telephone Exchange

NOTICE is hereby given that it is proposed, under the provisions of the Public Works Act 1928, to execute a certain public work, namely, to construct a post office and automatic telephone exchange, and for the purposes of that public work the land described in the Schedule hereto is required to be taken; and notice is hereby further given that the plan of the land so required to be taken is deposited in the post office at Kumara, and is there open for inspection; that all persons affected by the execution of the said public work or by the taking of the said land should, if they have any objections to the execution of the said public work or to the taking of the said land, not being objections to the amount or payment of compensation, set forth the same in writing and send the written objection within 40 days of the first publication of this notice, to the Minister of Works at Wellington; and that, if any objection is made in accordance with this notice a public hearing of the objection will be held, unless the objector otherwise requires, and each objector will be advised of the time and place of the hearing.

WESTLAND LAND DISTRICT

ALL that piece of land containing 1 rood situated in the Borough of Kumara, being Sections 102 and 103 of Reserve 128, Town of Kumara. All certificates of title, Volume 7, folios 165 and 206 (Westland Land Registry).

Declaring Land and Easements Over Land Taken for an Electric Power Substation in the City of Wellington

PURSUANT to section 32 of the Public Works Act 1928, the Minister of Works hereby declares that, a sufficient agreement to that effect having been entered into, the land first described in the Schedule hereto is hereby taken for an electric power substation and shall vest in the Mayor, Councillors, and Citizens of the City of Wellington from and after the 31st day of July 1967; and also hereby declares that easements in connection therewith, and forever appurtenant thereto, are hereby taken over the land secondly described in the said Schedule hereto, vesting in the Mayor, Councillors, and Citizens of the City of Wellington the full and free rights, liberties, licences, and privileges in perpetuity, that is to say:

(a) The right to transmit electrical energy backwards and forwards, under and along the land secondly described in the Schedule hereto.

(b) The right of ingress, egress, and regress on foot, with or without vehicles of all descriptions, either loaded or unloaded, by night as well as by day, over and along the land secondly described in the Schedule hereto.

(c) The right to enter upon all or any of the said land secondly described, at all reasonable times by its servants, agents, and workmen, with all necessary tools, implements, plant, machinery, and vehicles, for the purpose of laying, constructing, repairing, renewing, and maintaining at such depths as shall be necessary, all cables and fittings as shall be required for the unimpeded transmission of electrical energy as aforesaid.

(d) The right to dig up and break the surface of the said land secondly described or any parts thereof, and generally to do and perform all acts and things as may be necessary or proper, including re-instatement of the said land for the purposes hereinbefore mentioned: PROVIDED HOWEVER that the registered owner of the said land shall be given reasonable notice before any work is being carried out, and there shall be caused as little interference as possible to the said registered owner’s access to Mersey Street, from and after the 31st day of July 1967.
