Act 1941, and the classification is deemed a valid classification

newspapers circulating in the district, namely, the 28th day of
May 1965.

CHARITABLE TRUSTS ACT 1957

IN the matter of the Bowen Hospital Trust Board:
NOTICE is hereby given that an application has been made to
the Supreme Court of New Zealand, under Part III of the
above-mentioned Act, by the above-named Board, for its
approval of a scheme for the extension or variation of the
powers of the Board and the mode of administering the trusts
of Deed of Trust dated the 17th day of March 1964. The said
Deed provides that the trustees are empowered to appropriate
up to one-quarter of the net profits of the hospital business to
a Land, Buildings, Plant, and Fittings Reserve Fund. They are
also empowered to appropriate up to one-quarter of the net
profits to a Losses and Working Capital Reserve Fund, and the
balance of the net profits are to be paid and applied for such
charitable purposes as the trustees shall, from time to time,
think fit. Under the scheme proposed, which has been filed
in the Court, and a copy of which may be inspected at the
offices of the under-signed solicitors to the Board, the Board
will be empowered, for a period not exceeding ten (10) years,
to set aside and appropriate to a Land, Buildings, Plant, and
Fittings Reserve Fund all, or such part as they shall, in their
discretion, think fit, of the moneys for the time being standing
to the credit of the Losses and Working Capital Reserve Fund,
or constituting unallocated surplus profits, and will likewise
be empowered to appropriate to such reserve fund, out of the
profits of the hospital business, in any year, such sums as
they shall, in their discretion, think fit.
The said application is set down for hearing before the
Supreme Court at Wellington on Wednesday, the 5th day of
April 1967, at 10 a.m.; and any person desiring to oppose the
said scheme is required to give written notice of his intention
to do so to the Registrar of the Supreme Court at Wellington,
and to the Board, and to the Attorney-General, not less than
seven (7) clear days before that date.
